SOL on Dissolution Final Judgment
Does anyone know what this would be in Florida, if there is a SOL on a disagreement with the Final Judgment.
History.
I was served with Dissolution papers. I had everything typed out and prepared and notarized in enough time under the 20 day rule to respond. I was arrested that same day on a purge. Because I was not put before a judge within 48 hours as stated in the Writ of Habeas Corpus....I was released, but not until after 7 days had passed and my ex's attorney filed Default papers on me for non response to the Dissolution.
I contacted the court and the clerk of court days later and asked how to proceed. Was told to file the papers anyway, and to file a Motion to Set aside the Default and Final Judgment.
I did so, but the judge chose not to sign either order, and Finalized the dissoluton; adding a notation that an evidentiary hearing was necessary. after failed attempts to coordinate a hearing with opposing counsel...several months have passed.
Any thoughts or comments?
