Guardian Ad Litem

Can anyone give me any advice on such a representative and if a Guardian Ad Litem is beneficial in a Dissolution/custody case?

Any real life situation or experiences with a Guardian Ad Litem?

Anything would be appreciated.

What is the state you are in?
Currently I am in conflict with the State of California, they are the worst.
I am helping my son, get his children back, they were place in guardianship without his consent.

A Gaurdian Ad Litem or Law Gaurdian is nothing more than an attorney for the child, and makes all legal dicissions for the child, kind of like power of attorney. My son has one of them, NOT by my choice, I would suggest based on my experiences with them to go get professional mediation instead.

A Gaurdian Ad Litem is just ANOTHER officer of the court, and as such, won't bite the hand that feeds him/her. Regardless of what is best for the child, or the parents, you can rest assured, their decision will be what is best for the state, first.

If I had to do it all over again, I would deny the STATE jurisdiction from the beginning, and remove them (the court and the GAL), and their authority/opinion, from the situation entirely. From my (sometimes not so humble) perspective, the matter of custody/primary residence, is between Mom, Dad, and their Creator, only.

If you allow the STATE into your situation, then any decision the court (STATE) makes will include all those black uniformed mental midgets, with blind obedience, and guns, to make sure you do as your told.

I know I will regret this response but here goes. I had no choice in the courts being involved. I tried talking to my child's mother 3 to 4 times before the courts were involved. The courts primarily became involved (through the Department of Revenue) because my child's mother decided she would try and raise 3 children alone (2 were from a previous relationship) without getting employment for the first several months following our separation. Yes, I could have gone and taken my child from her at that point, but then I would have been up on charges of kidnapping. The state would have "shot" first and asked questions later. You and I both know that.

So what was I supposed to do? What can I do now?

Hindsight is 20/20.... All our situations would be different, if we had known then, what we know now... My 'Family Matters' situation was my personal 'kick in the ass' which started me on this 'odyssey for truth'.

Basicly, I would have employed the 'common law default affidavit method' as refined by Clyde Hyde of the Yahoo group 'Lawork(s)', otherwise known as the 'Ticket Slayer' docs. 9. Person. "Person" means an individual, trust, estate, partnership, association, company, corporation, political subdivision of the State, instrumentality of the State or other entity.

Again, are you a 'person' created by congress/state, or are you a creation of the 'Creator'? Who's your master?

Do you still have "Rights and Responsibilities" with you children? If so, then you can claim, thru affidavit and verbally, that they are creations of God, and are not congress/state created entities, along with yourself !

Do you see where I'm going with this?


You'll need:

constant study to prep yourself mentally for the challenge

18-20 days, and $100, to prep and establish the TS docs, and other relevant paper work

100 days, and $1000, to get your apostilled docs of expatriation thru www.pacinlaw.org


It is so difficult to take an offensive stance, rather than defensive, against the STATE, in the courts today. Before the apostilled sovereignty docs, I had considered, getting my ducks in a row with a few dismissals, and then purposefully violating the court orders, just so they would drag me into court, so I could rub their noses in my paperwork/lawfully defaulted status. As soon as I got things dismissed, I'd go out and violate them again, and repeat the process, until they left me alone ! lol

But today with PacinLaw's process, I no longer see that as necessary.

Why is the Apostille important?

Look in Bouvier's Law Dictionary, 1856 Edition, it's all right here:

MAXIM. An established principle or proposition. A principle of law universally admitted, as being just and consonant With reason.

2. Maxims in law are somewhat like axioms in geometry. 1 Bl. Com. 68. They are principles and authorities, and part of the general customs or common law of the land; and are of the same strength as acts of parliament, when the judges have determined what is a maxim; which belongs to the judges and not the jury. Terms do Ley; Doct. & Stud. Dial. 1, c. 8. Maxims of the law are holden for law, and all other cases that may be applied to them shall be taken for granted. 1 Inst. 11. 67; 4 Rep. See 1 Com. c. 68; Plowd. 27, b.

3. The application of the maxim to the case before the court, is generally the only difficulty. The true method of making the application is to ascertain how the maxim arose, and to consider whether the case to which it is applied is of the same character, or whether it is an exception to an apparently general rule.

4. The alterations of any of the maxims of the common law are dangerous. 2 Inst. 210. The following are some of the more important maxims:

"Partus sequitur ventrem; The offspring follow the condition of the mother, this is the case of slaves and animals; but with regard to freemen, children follow the condition of the father."

So, how soon do you want to start the process?
