custody battle in MI
In procees of fighting for legal custodity of my 2 yo daughter. A motion was put into service for hearing granting my ex full physcil custody. I showed at the hearing which was on the docet and it was adjourned. Due to fact that her lawyer diddent show but court informed me that they contacted him and requested his presence.. Courts in cahots? definitly cause had i not showed would have run motion but since he diddent they had to adjourn it.. Is there any way to get through the hubbub of the system? Question my ex left and took minor child she witholds time and visitation to her preferances shes trying to establish this as rights to full custodity but what recourse do I have? Cant go and take child and hold her. risk kidnapping, or demostic violence. how do I go about forcing equal time?

I am no authority on family court matters, but if the attorney for the ex didnt appear, I would object strenuosly and motion for summary judgment in your favor due to the fact the shyster didnt appear.

Maybe you have heard the phrase; possession is 9/10ths of the law.
So many times I have heard about the mother leaving with the kids and then dad doesn't see them until the court grants visitation, Wed. eve's plus every other weekend.
OR dad leaves, because he is trying to be reasonable and then gets the "visitation" axe.
DAD'S, DO NOT LEAVE YOUR CHILDREN! Become more involved in their lives even if it means changing jobs, working from home or working part time while the kids are in school. If you have to, put your career on hold. You can go back to it later.
The court usually will grant custody to which ever parent is the most involved in the children's lives.
Who gets them up in the morning?
Who feeds them breakfast?
Who gets them to school?
Who is home with them after school?
Who helps them with their homework?
Who takes them to practices and lessons?
Who spends time with them in the evening?
Who helps them with bath, teeth brushing, story, prayers, and nighty-night?
It is VERY important to safely get the kids in your possession. (sorry, no better word for it here)
Control the visitation at your place or a neutral place until a court decision.
If spouse behaves unreasonably, consider a restraining order, even if it is just for harassment.
Do your BEST to work out a time share agreement on a calendar. You will want the court to know you believe, it is in the best interest of the children, that they spend time with both parents continuously, consistantly and frequently.
Correct me if I am wrong but kidnapping charges are usually made on a parent unless there is a court order for when and who the children are supposed to be with.

Please don't drag anyone else into your sin(s), we have enough of our own'.

Did I miss something? That sounds pretty harsh... Didn't sound like brooktinker has an attorney.

HEY TAKE IT EASY WILL YOU!FYI: I have learned alot and tommorow is the first day of my new life.. Nomore working for me I am a full time stay at home dad I am going to obtain custody tommorow. Me and my little princess will be together for now on and mommy can come visit whenever she wants too. About the Shyster.. havent decided what to do about that I believe that holding him in retainment is favorable in the the eyes of the cash register<oh I mean the court>and it may be useful later on to keep the monkeys off my back. File anything that needs filing. I have informed him to bring the FOC in for a interview and review of the custody situation and to do an investigation as is there obligation to the court. these are the ones that determine the equibility of the matter at hand.He also will not accet any agreements in court with out my approvel he will be relieved of his counselour duties on the spot and for the record will be now speaking to the court in pro per.

Well so far the first morning isnt so great.. waiting to do the deed.. The Shyster???hmmm do i need him. What can i have him do.. and if he refuses?tried to fight before on another issue with out one and was railroaded but the system as in that i had no legal recourse. Now at least I am broke?? but i will have my kid..not going down , an eye for an eye. life for a life. Shes mine I made her I 'm keeping her time is short the end is near time to ride. I realize he is a crook but how do I get him to work for me? Is there a way to make him do his job?If I end up in jail for taking custody of my kid when none has been established or ordered I am gonna be fire up!
