its not a contract...
...but its an agreement.
A contract requires a consideration whereas an agreement does not. Here's a good article from www.commonlawvenue.com click on What is law?
The license pertains only to the person administering the ceremony not the parties thereto. But the parties purchase the license on behalf of the administrator. The administrator also has a contract with the state specifying that they will only administer statutory marriages. The catch 22
By applying for the license (for the preacher) you are asking the state to administer a statutory marriage for you. You have a contract with the preacher to perform the ceremony and an implied agreement with the state to follow their BS rules. The preacher assumes you know this already.
The preacher then files his paperwork, ( affidavits, certificates, etc. ) and the giant sucking sound begins.
wargames, you cannot have a copy of the affidavit because its none of your business. You applied to the state to ensure that they would ceaselessly meddle into your affairs and now you are covered with ooblak.
Perhaps you've looked into the cat in the hat as to remedy?

I especially like the miscellaneous laws that cover the Guano Islands near the end of the document. The analogy is too clear.
A good rule of thumb is never to discuss law with two people in heat.
