In Rem Jurisdiction
I was ready to start preparing a Brief and Affidavit to assert the facts that my "Private Property" is not binded to the Town's/Corporation's contract. However, I am having a tough time getting around the concept of In Rem Jurisdiction.
I don't think we want to challenge the definition of terms used in their statutes (eg Real Estate, Personal Property, Real Property, Property) as I think challenging the contract/jurisdiction is always the preferred method. But I just don't know how you can get around In Rem Jurisdiction unless it doesn't apply to "Private Property" (although I saw a court case that state Real Property = Private Property).
Actually, I believe they will use a 2-pronged approach to binding you into their scheme - In Rem and In Persona Jurisdiction. I think in persona jurisdiction is easier to remedy but regardless, can someone help me deal w/ In Rem Jurisdiction?
