New Patent Claim Process

Greetings,

This work is in need of critique. It parts from the traditional sandwich package and represents over two and one half years of work by several of us researchers. It would seem that the Application to Withrraw and the Certificate of Withdrawal are now defunct, but are included anyway for those under the Torrens system.

This package is tailored for Washington but can be modified for other States of the northwest.

Directions:

The application of this process has not been tested in Washington. It follows the rules, mostly. A modified version of this (the confirmatory instrument) has been used in California but it was very difficult to get filed.

Hopefully, one would walk into the registrar’s office prepared to come out with the certificate of withdrawal.

The RCW says that the forms (1 & 2 below) should be substantially in the format provided in the codes. This leaves room for modification of the templates provided by the State, which we happily accommodated.

1) File application to withdraw. (now defunct unless registered under the Torrens Act)

2) Have registrar sign the custom certificate of withdrawal. (now defunct unless registered under the Torrens Act)

3) Use the included cover letter to file the claim to patent package. The cover letter follows Washington codes. Under the cover letter and include the following in this order.

4) Certified Copy of Application to Withdraw. (now defunct unless registered under the Torrens Act)

5) Certificate of Withdrawal. (now defunct unless registered under the Torrens Act)

6) Notarized Confirmation of Assignee’s Chain of Title.

For number 6 above, I obtained all the certified documents relating to chain of title for the property in question and consolidated them into one notarized brief to save filing fees and paper bulk.

7) Certified Copy of Original Letter Patent.

8) Confirmatory Instrument and Notice of Acceptance.

You will need Am Jur 2 and Blacks Law 6th to follow this one, number 8 is the heart of the work. It will be EXTREMLY HELPFUL to print this on 14" paper and refer to the sources cited by number in the body as you read and refer to the legal sources.

Feel free to critique, for personal use only.

Note: There is a deliberate attempt to play and flow with the different venues and jurisdictions as the property is moved from one to another during the de-registration process, e.g., state of Washington, State of Washington, county of Thurston, Thurston County, THURSTON COUNTY etc. Some work yet needs to be done on this especially tying this in with the powers of the notary.
