Check your deed and see if you are required to shovel it. Also check your CC&R's. (Code Covanents and Restrictions) If it doesn't say so there I believe you have checkmate. Just because they have an ordinance doesn't mean it will override your deed and CC&R's.

However I have tried to walk past your house several times and because of all the snow I just can't get past it!! LOLOLOL

Yeah, but you see, they don't want us to know that. If the judge knows that and understands that, he will 99.9% of the time dismiss the case so that he doesn't have to admit that they are fraudulently forcing us into that state (of not truly owning our land). If that ever got out (in an established case), they'd be in deep crap.

Basically what would happen if they did "get" me on it, they'd have to admit that I don't own the land because it's "their" land. I go on record as saying "For the record: your honor, what you are saying is because I do not own an allodial title to my land, I must comply with the city ordinance?" If he actually replies "yes" then I reply "For the record then your honor, that means that if I were to own my land in allodial title at this present moment, I would not have to comply with this ordinance?" At which point he will either have to blatantly lie, or say "yes". NOW, that goes in record in their case law, and it opens up so much crap on their heads it's not even funny.

So you hire your own private court reporter, have them verify their service and check their record with the official court reporter, get a copy of both, notarize them, and have multiple witnesses on hand.

Just make sure the wife has a bikini on when shoveling...That may take their mind off the issue (temporarily!). Post your property. A VERY small "No Trespassing" sign is sufficient. If they come on your property without a warrant, let 'em have it!

He'll be at the hospital, by his wife side, taking care of her bikini-induce pneumonia. Ha!

But, seriously, I have the same problem with a pothole located between the sidewalk and the middle of the street. I already checked my city's code and Public Works is supposed to take care of that. I called them up and I was told it was my 'responsibility" to take care of it. I told them that area is not in my home survey and not included in the legal description of my lot. They insisted on my "responsibility". I asked if that area is "mine" then. They said I'm suppose to "maintain it". Me, "it's mine, then, and I'll build a water fountain there to soften the noise from the traffic. You know the traffic on my fron street is heavy. The sound of water will dimisnish the noise and relax me" They, "You can't do that, lady. If you do that you will receive a citation", Me, jumping out of excitement (the equivalent to "boiling blood") "Yep. I want it posted on my door tomorrow! So it is mine to keep and yours to enjoy" Them, "Well, don't get upset. We call that the abused area because cars park up there and damage the street when they leave. Don't you have parked cars there" Me, "Not my cars. Others cars, and very often they are your cars, city cars stop for a moment there to look at something and never ask my okay to do it".

To shorten this, They asked for pictures. I offered the pictures and a letter asking them to give me the reasons " in writing" for not fixing it, (if) they won't. Should cite the "statutes or laws" making me "responsible" to keep the street.

My taxes are abusive, $4,500. The more I see the more I believe. I see things with new eyes now. Abuses that had "passed" unnoticed before.

This is just what I heard and not gospel but registered is non-commercial, and certified is commercial.

Send them either an acceptance of their offer to contract or a refusal. Senate Do***ent 42 Resolution #63...(numbers might be transposed but I have a copy if you wish to read it) claims that the state owns all property; THEREFORE it is their responsibility to maintain said properties.

On the otherhand, do the work and send them a bill.

Send them an offer to contract for your services to perform road repair at such and such place and indicate an amount like $50000 (or more) blah blah

Do you have the guys name you talked with. Maybe you could say it was authorized by him (since he told you to do it) and for them to please sign so work can commence. As part of the contract tell them the city would be required to pay half up front and half on completion.
