Land Patent - How fast can I generate the paperwork?



I just found out today that some very good friends are going to loose thier home on the 19th.


Does anyone have an estaimate of how long it would take to put the paperwork together for a Land Patent?


Would a Validation of Debt even slow them down?& Will a Certified Promissary Note work?& Based on what I read a Bill Of Exchange is this forums preferece, but I have never done one.


If they simply file for bancruptcy do you think they will they be allowed to keep thier home in northern California?

Filing for Bankruptcy will halt the action... but I would recommend a chapter 11... in this way any payments made for any "debt" would be applied to the principal balance only.

A land patent is a must. But you should also read up on "Notice of Lis Pendens".

I don't think anything is like that in the downloads section but, a Lis Pendens is a powerful tool.

This is a gutsy way to attack it, but if you view this idea from Winston's point of view, you go into bankruptcy (which as stated above will halt all forclosure proceedings) to find out the assets of the CREDITOR! The creditor has to file a claim, and if you look closely at the bottom of the B-10 Proof of Claim form where the creditor's signature is required, it states: "Penalty for presenting fraudulent claim: Fine of up to $500,000 or imprisonment for up to five years, or both. 18 U.S.C. 152 and 3571."&


Now, we all know the mortgage company's are committing fraud in their lending practices.& The question now becomes, is the claimaint willing to wager that you cannot uncover their fraud? I know if I was a lender and I was presented with evidence of&my fraudulent lending practices, I don't think I will be the one to step up to the plate and place my signature on that form and accept that liability.

I am still looking over the information you sent and I am still trying to formulate intelligent questions.& But let me ask just one.& You talked about "motion to dismiss based on the fact that the land patent prohibits any governmental administration in regards to the land forever."

Are you talking about a motion in bankruptcy court?

Everyone-
I just found out that they took a bankruptcy ~2 years ago so that will not work.

Based on what I read about Land Patent it is the best way to go if I can figure out where to get the land description and where number actually comes form.

I briefly looked into Notice of Lis Pendens (i.e. pending litigation).

In surfing around I have seen it used by mortgage co's in forclosing on properties, "warnings" to potential buyers that litigation is pending (they may become embroiled), and even a "commercial lien."

Where you suggesting that a Notice of Lis Pendens be used with a Land Patent or simply to "suspend" the forclosure procedure ~30 days?

Motion to dismiss any court action brought against the property based on the Land Patent.& The judge cannot make any decisions in regards to any land under patent... completely free of government administration.
