Land Patents-Again

My cousin and I went to the court house and went to the office of records and spent half a day looking through big books from 1836 on.& We also took our family history to get the names of relatives right.& We have warranty deeds for all the land that we are wanting to get patents on, and we did find some entries that our great-grandfather had deed to some land.& However the land descriptions didn't match.& This appeared to be land right next to the land we are trying to get the patents for.& WE looked into the big books all the way up to where the land was deeded to her father and my mother and another aunt.& But we couldn't find where the land was ever deeded to our grandfather (who deeded the land to our parents).& Is there anyway to do a cross reference on the land by the description of the land and trace the last patent issued on that piece of land?& I know everybody is tired of hearing about land patents, but we are kind of stumped and aren't sure which way to go now.& We have one of thopse big amps that shows all the land that originally belonged to our grea-great grandfather.& The only land that we could find deeded was land that was deeded to one of our grandfathers brothers.& And yet it was our grandfather that deeded the land to that brother.

I'll quit rambling.& Anyone have any ideas?& I was wondering if you contacted the BLM and gave them a description of the land, they could tell you the last land patent pulled forward, by who and the number.& Anybody know?& Ice, Jersee, James, Sui Juris, Jim-any ideas?& (I know we all depend on you guys so much- but at least you know a lot of people are remembering you in their prayers.)

Thanks,

Wirlwind

Wirlwind,
I made a post this morning in re: Randy's search, on how to trace land titles. (link someone please)
The land patent is only issued once by the BLM. After that it is gone from them, it is out of BLM's hands. They do not track any more owners. You can assert your rights to the patented land without doing the full trace but don't take a vacation. There will likely come a day when you will need that unbroken chain of title. So go get it. Besides, it sounds like it is your family history. Make it fun!

Jim,

I read the post from earlier to Randy's post.& And I have copied it off.& We are going to go next week again and see if we can come up with more info by doing what you said to do.&

This land has been out family since before the civil war.& And we have found some records, but the ones for the specific tract of land that we are interested in has eluded us.& But we are going to keep looking.&

Thanks,

Wirlwind

Re:Land Patents-Again

wirlwind,

The land patent would probably have been for a large portion of land... and the property you sit on is only a small piece of that land under the patent. The land patent was issued only one time... all you need to do is assert your right in the patent (need the number) in regards to the small piece of it that you sit on.

And, as Jim has stated, a chain of ownership that demonstrates how you came to possess the land is one of the keys... the other is "possession".

The point is this: you do not "get" a land patent... it's already there. All you do is assert your rights under the patent.

The only thing we could find in the big books were deeds.& We weren't able to find any patents at all.& The girl that worked there didn't seem to know what we were talking about.& she didn't know what a land patent was.& She said they had a few people that were "getting" (term she used) land patents, but she didn't know how they did& it.& We are going to go again and try to find and auditor& like Jim mentioned and see if we can get more information.&
