LAND PATENT AGAIN-Paperwork ready-have question



My cousin wirlwind and I have been working on getting land patent, and we have our paper work ready.& But before submitting paper work to BLM , I want to be sure this can work..Here is scenerio:


&


(A) is the&assigned heir who lost property through foreclosure, then sold redemption rights to (B).& Then (B) ejected (A), and has sold to (C) under purchase- with-option- to-buy contract. My question is:& Can (A) still bringforth land patent, and get land back from (B) and (C) if&land patent has not been brough&forward by (B) or (C)

If your rights in the land patent were asserted prior to any others "possession" -- you would have been protected from ejection from the beginning.


But, if the property was lost in foreclosure... and then sold to another... all hope may not be lost.& How was the foreclosure handled?... was it a summary judgment?... what are the details?


Members, without&DETAILS of any given situation it is not possible to offer any suggestions, opinions or advice that might be beneficial... so including some background with questions could lead to another solution.& If you talk about land --& list what the important details are.. such as "Discharged with VOD/CPN -- Forclosed -- summary judgment --- blah, blah".


Remember this:&The road you decided upon&may not even be the best possible route to take... there may be other avenues, using the tools of the law, that will reach your goal a lot quicker with a lot less hassle.& It might even be possible to make your goal completely unreachable by attempting the wrong&process, at the wrong time and in the wrong way.& Providing more details allows for more assistance.

Sometimes, we don't know what information to include.&(I'm only speaking for myself because about&a lot of this stuff I feel dumber than dirt).&How would we find out if the foreclosure was a summary judgement?& Also some of the land was sold in the 70's by our family to take care of our grandparents.& Then that land was sold again to the man who now owns it.& We may not be able to get that back.& I wouldn't even try accept this guy is one of the biggest a-holes that ever lived and he has tried to make my 87 year old Uncle's life hell.& He has put up barbed wire fences that have caused horses to have to be put down because of getting tangled up in them and a whole bunch of other things.& And no one was trying to go on his land.& The fences were actually over on someone else's land, but he put them up.& But the point is, we aren't trying to be that heartless except for the fact that this guy is a real jerk, and we want him out of the area if at all possible.& Then when the land was lost to foreclosure- guess who bought it. Found out that the president of the bank and this guy were friends.& Thry were foreclosed upon when they were 2 months late.& My cousin went in to make 2 payments which would have brought her current on her payments and the bank refused her payment.& They didn't take her to court to foreclose,&she simply received the letter in the mail saying that they had been foreclosed on.& My cousin's land joins the land of the jerk that bought the other land, and we believe that he had some sort of deal with the president of the bank where their mortgage was.& No proof, just conjecture.&


That is some more information as I understand it.& kgji may have more details and she will probably be back on to give you more.

Now that foreclosure sounds really fishy... there would be much more detail needed about that... maybe even a look at the mortgage contract.
