standing on public land?
I have a few govt maps, and I've been looking at claiming and whatnot. I can't patent it even if I claim land, since the BLM has refused to issue patents on claims for yet another year (12 now). So then I got to thinking, is there any reason I can't "stand upon" land identified as "public land" or "national forestry land?" It has no title, and no one has had a previous claim.
Can the government even own the land in the first place?

More than likely your land has a patent number... all you need do is assert your rights in that patent for your particlular piece of it as an assign.
We don't "patent" land... we just assert our rights in the patent that already exists.

The government (original jurisdiction) only holds the title of public lands in trust for We the People - it doesn't own the land. Lets not confuse public land for any land that Corp US has obtained through color of title - all patented land is private and beyond the reach of state or federal government. Upon entry into the Union, a state is required to relinquish all title to its public lands (unpatented at the time) over to the federal government (to hold in trust for We the People) - except the Republic of Texas. Although such land is public, it doesn't mean just anyone can walk up and stake claim to the land - it must be purchased from the trust to transfer ownership from We the People to a private man or woman (or to a corporation through explicit Congressional approval). When public land is purchased from the federal government, the BLM will issue a patent signed under the hand and seal of the President of the United States of America. In short, your land is granted through a Treaty with the government.

Doesn't application for the land patent necessitate some sort of warranty deed or quitclaim? What would be done without such a note?
Since the land has a patent number, where could it be recorded? i.e. how would you include that in the declaration of land patent?

over on teamlaw.org, I got the impression that since there is no original jurisdiction pres, I can't get a new patent. I just learned that the teamlaw guys, and others, are working to elect an o.j. governor in every state, then an o.j. congress, and finally a legitimate president. Until that happens, is there any way for me to purchase land from the REAL united states govt?
And we're not talking 'homesteading' here, free land is gone... Anyway, I'm filing for a mineral claim--a mine--which gives me the right to build whatever structures are necessary to maintain that mining claim.

Take a look at some of the older threads for more info regarding asserting rights in the land patent. There is a lot of information here that is overlooked... there are pages and pages of threads that contain valuable info.
You might want to print some of it and put it into book form for easy reference.

Alloidal Title?
Would there be any other way to procure a land patent for "unregistered" BLM land? If the gov't claims ownership, then there would have to be evidence of title or patent, correct?
Ice made the comment about lands having an original patent number - what about land that has never been property? Is there a patent system for those, too?
I'm curious to know how one could take Alloidal title to BLM land. It is called the "Bureau of Land Management". By it's very title the office only has stewardship of the lands. Besides, if possession doesn't convey ownership in regard to our homes (Real Estate), the same must be true of the gov't, I suppose.
