which courtroom?

Hi,

I am brand new here, so please bear with whatever ignorances I exhibit.

I have a hearing to attend. I am trying to find out how to make sure that I appear before a judge, as opposed to a magistrate, and that the issue will be decided at law, as opposed to being decided by convention. What type of court do I insist upon appearing in? I am familar with notifying the court that I am appearing by Special Appearance, and am somewhat familar with demanding that the plaintiff provide an affidavit swearing that he has suffered harm as a result of my action. But how do I get to where I want to be heard in, please? Thanks

Postpone the hearing until you know what you are doing. You mainly want to find the Judges Oath of office and have him take judicial notice of it. You are going to need a lot more ammo to get anything done though. They will try to roll all over you.

Welcome to the forum, twobits..



As you no doubt have gathered by reading some of the posts here... it is darn near IMPOSSIBLE to get yourself before a REAL article III judge... and any other 'black robed individual' you find in a court room is going to be a magistrate, not a judge.



If your concern is over a civil matter, there will be a generic form at the civil window called "Request for Judge". It is only a couple of lines, and basicly, only needs your signature. BE ADVISED, this will not get you anything close to an Art. III judge, but will only get you before a magistrate. But this option beats the heck out of being in front of a CMO (certified ministerial officer???) who, generally are nothing more than lawyers who couldn't make it as such, and took a 40 hour course on how to be a psuedo-judge/magistrate.



If the matter is criminal, then skip the above, as you will already be before a magistrate. Now the trick is to get them to judicially notice the Constitution and convert them to a judge ! You will find much adivce within this forum on how to do that...
