Question about car payments

A friend of mine owes on his car and is a few months behind. The company is threatening to call the police and claim it as stolen property...

my question is this illegal and how is it illegal.

They're just trying to bust his chops.

The car's title is in his name with the finance company also on it.

He has the registration papers in his name.

If they DO report it stolen, they're on the hook for (1) filing a false police report -- usually a low-level felony and (2) a law suit from your friend to recover his costs plus punitive damages.

They know this, so they're not going to make the report. They're just shaking his tree.

They WILL most likely send out a repo man to recover the vehicle.....after 60 days past due.

He is over 90 days past due. He is afraid they will press charges but i will give you all his responses

Unless there are some things unmentioned (such as trying to use a worthless check), this is entirely a civil matter and it is unethical for the auto company to threaten criminal action to bring pressure for a civil claim. The car company can obtain a court order to repossess the car.

I had my 2003 Infiniti towed by the City of New York for $1200 in unpaid parking tickets. Toyota Financial paid the fines, took the car and held it. I called the Federal Debt Relief System, they told me not to make another payment on the car, they could get me out of the $23,000 loan completely. I let them auction the car, and I'm using the FDRS to hopefully wipe the debt off my credit report permanently. Does the FDRS actually work? It better, because I have no other options. The loan has gone into default, or it will any moment.
