commercial liens

A few days ago, I sent the article about commecial liens to a friend of mine who is of like mind. She responded that judges were now throwing these liens out and imposing sanctions upon the filers, claiming that the liens are frivolous. Is there any truth to this, or is it a rumor being spread to keep people from doing it?
In the article, it states that if one does NOT follow the procedure exactly, that it can have bad repercussions upon one. This I believe whole heartedly.
So, if anyone can cite any actual court cases from the last 5 years or so that show any kind of general trend of judges to be disregarding commercial liens, then please do so.

Please read the commercial lien info again.& There should be cases cited.& If you will notice, there are statements that assert a judge cannot "throw out" a lien that is used as a "bond" in order to protect your rights during a court action.


Take the conversation with your friend to those points and go from there.

whats sad about all this is we have the right to contract and use the first amendment. they are trying to snow us into thinking that we cannot contract and file affidavits. why is it if a creditor sends you a bill that you never heard of before, but if you dont respond, you go into dishonor and owe the bill, and when we turn around a use it against them, they say its frivilous? this all comes down to heart. do you have the heart to withstand potentially going to jail. Ice is right about bonding a case with a lien. Now, as far as "punishing" them with a lien, sure they gonna threaten and maybe even jail you. why wouldnt they. again, how much heart you got, and make sure you give them plenty of notices. YOu cant predict the future with what they will do.

OK, when I wrote the post, I put in the relevent facts first. Namely, that I was given some info that I thought might be bogus and wanted to confirm it one way or the other. And then I asked if anybody knew of any ACTUAL CASES OF LIENS BEING VOIDED by a judge. So if anyone has this info, please put it up for all to see.
I will contact my friend again and see if she can cite any such cases. Maybe I should have done that first, but I also want to hear from a greater number than just one person who may not have all of the facts.
Yes, if one is cowed by merely a stern sounding judge, then they get what they deserve.

A judge cannot legally void a lien that has been placed using the correct notifications and the other steps required.

Of course the article is a propaganda piece, but if you skip the authors opinions and pay special attention to the facts, (when they are actually given) you will note that anyone who got in trouble or had a lien removed generally did not properly notice the party on which they filed the lien. They simply skipped all the steps and filed the lien. In my opinion, in the cases cited in the article above where people got into "trouble" using the liens were asking for trouble.

to add to sui juris reply, if they attempted to remove the lien (which is a felony) you can still post it in the newspaper for 4 weeks. can they remove that? i dont know of anyone who has a lien removed but i have a family member that was sued for credit card debt. My family member&took them&to federal court and had placed a lien on the credit card company and the FEDERAL JUDGE told the credit card company it was best for them to settle the case because of the lien. Now, i know that much about liens. they do work.

Yes, they surely do work. There are different ways to go about filing them, I know Ice has a method that involves a true bill and citizen's jury prior to filing the lien. This is the method I would probably use if I were going after a high ranking person, because you have a full confession from them prior to filing the lien. If they ever go into court to try to remove the lien, they would have to commit prejury.

However, a lien is a lien, and if the proper steps are taken, and the lien has been filed, your opponent's ONLY legal option is to settle, on YOUR terms.

Read through the propaganda at the link above, and other sources calling all liens filed against government officials and financial institutions to be frivolous, and the truth still shines through: the lien works, and those who would have you to believe otherwise are cowering in fear.

Blacks says in re to "frivolous": Lacking a legal basis or legal merit, not serious; not reasonably purposeful.
It is up to the filer of a claim to understand why the purpose and legal basis of said claim exists. Once you understand this, it should clear up any doubts.

The power of the pen is still very real, step into any court in this land and you will witness this yourself. Do you think that judges and lawyers are the source of this power?
