Don't know if this is of any assistance or interest but in perusing my Florida Rules of Court - Federal (2003) last night I found that under
FRAP 45 Clerk's Duties it states that circuit clerk must take the oath and post any bond required by law. They just don't provide the oath of office for the clerks.
FRAP 46 laying out the requirements for the attorneys the application oath/affirmation states:
Quote:
|
I, IAM esquire, do solemnly swear (or affirm) that I will conduct myself as an attorney and counselor of this court, uprightly and according to law; and that I will support the Constitution of the United States.
|
In the Florida Rules of Court - State (2003) the Oath of Admission [to the BAR] is provided pp1635. In a research note it is stated that
Quote:
|
Amendments to this oath are published, as received, in the Southern Reporter 2d and Florida Cases advance sheets.

The general principles which should ever control the lawyer in the practice of the legal profession are clearly set forth in the following oath of admission to the Bar, which the lawyer is sworn on admission to obey and for the willful violation to which disbarment may be had.
Quote:
I do solemnly swear;
I will support the Constitution of the United States and the Constitution of the State of Florida;
I will maintain the respect due to courts of justice [is there such a creature anymore in this country?] and judicial officers;
I will not counsel or maintain any suit or proceedings which shall appear to me to be unjust, nor any defense except such as I believe to be honestly debatable under the law [does this mean that they are not suppose to be using statute or code rather the actual LAW?] of the land;
I will employ for the purpose of maintaining the causes confided to me such means only as a consistent with truth and honor [does this mean they are suppose to be revealing the fraud?], and will never seek to mislead the judge [again, what about the fraud] or jury by any artifice or false statement of fact or law;
I will maintain the confidence and preserve inviolate the secrets of my clients, and will accept no compensation in connection with their business except from them or with their knowledge and approval;
I will abstain from all offensive personality and advance no fact prejudicial to the honor or reputation of a party or witness, unless required by the justice of the cause with which I am charged;
I will never reject, from any consideration personal to myself, the cause of the defenseless or oppressed, or delay anyone's cause for lucre or malice. So help me God.
