STATUTORY AND REGULATORY FRAMEWORK.

Section 307 of the Tariff Act prohibits the importation of goods that are the fruits of forced labor, declaring, inter alia, that "[a]ll goods, wares, articles and merchandise mined, produced, or manufactured wholly or in part in any foreign country by convict labor and/or forced labor and/or indentured labor under penal sanctions shall not be entitled to entry at any of the ports of the United States, and the importation thereof is hereby prohibited, and the Secretary of the Treasury is authorized and directed to prescribe such regulations as may be necessary for the enforcement of this provision." 19 U.S.C., sec. 1307 (1997)

The U.S. Cusotms Service was housed in the Treasury Department until March of 2003, at which point it was transferred, along with its authority over ports, to the Department of Homeland Security (DHS). At DHS, the functions of Customs have been separated into the bureaus of "Customs and Border Protection" and the "Bureau of Immigration and Enforcement" (BICE). Richard Bonner was the "Commissioner of Customs" at the Treasury Department, and now he is the "Commissioner of Customs and Border Protection" at DHS. Michael Garcia, an Assistant Secretary of Homeland Security, now heads BICE. BICE appears to be the bureau that has been vested with authority over the nation's ports, and thus the responsibility to enforce the regulations at issue. Either way, responsibility to enforce these regulations now lies with DHS, and ultimately with the Secretary of DHS and the President of the United States.
