Pembina Tribal Judge Arrested

The following came through this morning on an e-mail list I am subscribed to...


On January 25, 2005, at approximately 6:30 A.M. FBI agents and York County, SC Sheriff Deputies came to my home pounding on the door and then used a crowbar on the door before I could get to it. I was told immediately that I was under arrest. I asked what the charges were and was told by the agent that I was being arrested for issuing a warrant for the Newberry County Sheriff Lee Fosters' arrest. Since I have never authored such hideous paperwork, I asked for a copy of this alleged do***ent. I was told I would get the copy when they took me to Greenville, SC.
Upon walking out to the car, one of the deupties said they would be watching the house and arrest my oldest daughter if she drove her car as it has Pembina tags. I was further informed that DSS would be called as well.
I was taken to the York County Sheriffs Office and quesstioned about the tribe, and asked to give tribal members names who were local. I evaded the questions and bounced them back to the agent. A file folder with my name on it had various photos of some other women whom I was asked if I knew. I was told that they were also Pembina tribal members who were arrested previously. I doubt the claim, and it certainly wouldnt have anything to do with me.
I was asked how the tribal courts work, what my education was etc.
I was then taken to Greenville, SC and taken to the magistrate, first being fingerprinted and photgraphed. I was never given paperwork-complaint or affidavit until after I went before the judge. I then had to meet with pretrial folks-aka probation officer.
All do***ents signed were not signed but rather initialed with a reservation of rights. I was given a Public Pretender- whom will now be fired. I did talk with him on the phone while stranded in Greenville, SC. He asked if i was a 'freeman' and if I expected to win this case. I asked what a 'freeman' was and he stated he didnt believe that I didnt know.
I was charged with stating that I am a US Judge, but at the end of the paperwork they do acknowledge that I am a tribal judge.
I had to go to the Clerks' office to obtain a copy of the complaint and affidavit. Interestingly enough, a women with the FBI is the complainant and typed up the Affidavit, however she handwrote her name on the bottom left and wrote Special Agent FBI, but on the bottom left side, the Judge signed it and dated it and wrote 'US Magitrate Judge'. This was the judge who issued the arrest warrant, signed the criminal complaint as well as gave me a PR bond.
And they wonder why tribes want their own court system!
At any rate, I had to call a gentleman whom is working on sending me cases that I had never met to seek a ride home. I had talked to him a number of times, just never met him personally.
My oldest daughter refused to go back to the house, so we did end up staying in the office last night. I am not sure what the next move is and probably wouldnt publish it anyway if I did.
Please keep my family in your prayers. I am still willing and able to have cases brought before me. I am not overly concerned with the case, but the timing for additional stress is all wrong right now.

im not going to say i knew this was gonna happen, but i knew it was going to happen. Im familiar with almost every native american AND indigenous tribe who has tried to maintain their sovereignty and got railroaded by the feds. they are not gonna let you do it, period. they wouldnt let the american indians or native americans maintain their sovereignty when they came here, so today, huh.that aint happening.
