<TT>James L. Borden Sr., 47, of </TT></SPAN><st1:City><st1lace><TT><SPAN style="FONT-SIZE: 10pt">Bedford</SPAN></TT></st1lace></st1:City><TT><SPAN style="FONT-SIZE: 10pt"> died Nov. 6 in the booking area of the </SPAN></TT><SPAN style="FONT-SIZE: 10pt; FONT-FAMILY: 'Courier New'"><TT>Monroe County Jail, shortly after being shocked three times by jailer David </TT><TT>Shaw. A pathologist determined Borden's death resulted from an enlarged </TT><TT>heart, pharmacological intoxication and electric shock.</TT>

<TT>Special Prosecutor Barry Brown, during a hearing Thursday, requested that </TT><TT>Shaw be charged with felony battery and that a second jailer, Chris Hutton, </TT><TT>be charged with misdemeanor assault. Monroe Circuit Judge Marc Kellams did </TT><TT>not immediately rule on the requests.</TT>

<TT>State police detective Sgt. Chuck Cohen, who investigated the death, read </TT><TT>aloud sections of interviews with officers present during the altercation.</TT>

<TT>None of the officers' statements indicated that Borden had posed a threat to </TT><TT>himself or the officers at the time. The officers, including Shaw and </TT><TT>Hutton, said Borden simply did not comply with verbal commands.</TT>

<TT>John Potter, a Lawrence County sheriff's deputy who brought Borden to the </TT><TT>jail from Borden's home in Bedford, recalled seeing Shaw's teeth each time </TT><TT>he pulled the trigger on the stun gun.</TT>

<TT>"I think he was enjoying it," Potter told state police.</TT>

<TT>Jail officers have reported that Borden was kicking and struggling while </TT><TT>pinned, face down, on the floor with his hands cuffed behind him. Brown, </TT><TT>however, suggested in court that the prisoner may have had difficulty </TT><TT>breathing or may have even been dying at the time.</TT>

<TT>While pinned on the floor, Borden was shocked a final time before his face </TT><TT>turned blue.
Cardiopulmonary resuscitation did not revive him.</TT></SPAN>

I haven't run into any power mad cops yet.& Sometimes I think it's because I am of the female gender... I don't know, but every cop I've run into has been respectable.

They are not all bad, but they as sure a hell are not all good. Someone like Tora who has always been treated with respect is a minority.


I was once stopped for speeding and quickly&found myself flat on my stomach, hands cuffed behind my back. So here I am, face down on the left lane of a busy interstate, just me and the public servant. He decided that would be a good time to put his gun to my ear and scream at me. The man was completely out of control...


Was I scared? No. But I was very shocked - and that was a turning point for me. I hope we do not all have to have such an experience to wake up. But sadly enough, that is the only way for some of us - that is, if we are not killed in the process.

It "hit" me one day what "to serve and protect" means:


To "serve and protect" the state!


I drive a big-truck. I deal with DOT-cops all the time. The whole damned bunch is outta control. (And I ain't real fond of truck-drivers, either, since they are, generall speaking, the biggest bunch of die-hard "law and order" types you'll ever meet, but they are convinced that "traffic laws" don't apply to themselves! Dumbasses. All for a cop shooting a guy in the back when they guy runs because, surely the guy wouldn't run if "he hadn't done anything," but can't stand a cop for writing you a well-deserved ticket for doing 80 mph through a construction zone. And so on...)


Now it's ME who'd better shut up.

<P style="LINE-HEIGHT: 12pt">According to Crowder and her lawyer, the woman told him she was blind and hard of hearing, and asked him to read the entire warrant to her, but he refused. She said he placed it in her hands, walked outside and ordered others to start removing items from her yard. <o></o>
<P style="LINE-HEIGHT: 12pt">The city denies that the woman asked Marihart to read the warrant and maintains that Marihart explained to her why he was there. <o></o>
<P style="LINE-HEIGHT: 12pt">The woman followed the city employee outside. She was concerned that he and his co-workers had removed a family heirloom, a 90-year-old red toy wagon with rhododendrons in it. She asked to enter a trailer, where items from her yard were being placed, to feel around for the wagon. <o></o>
<P style="LINE-HEIGHT: 12pt">Marihart told her she couldn't enter the trailer and said the wagon was not inside. He then called police. <o></o>
<P style="LINE-HEIGHT: 12pt">When Portland Officers Robert Miller and Eric Zajac arrived at the house, Crowder acknowledged she had one foot on the curb and one foot on the bumper of the trailer. She felt someone step on her foot and asked, "Who are you?" <o></o>
<P style="LINE-HEIGHT: 12pt">Moments later, she felt someone strike her in the head, which dislodged her prosthetic right eye from its socket, and was knocked to the ground, she claimed in her lawsuit. <o></o>
<P style="LINE-HEIGHT: 12pt">Officers said Crowder ignored their commands not to climb into the trailer and tried to bite Miller's hand. <o></o>
<P style="LINE-HEIGHT: 12pt">They acknowledged she was "pushed onto the dirt next to the sidewalk," according to the city's legal brief filed in court. <o></o>
<P style="LINE-HEIGHT: 12pt">While on the ground, Crowder asked the officer what he thought he was doing and kicked Miller. She said the officer kicked her back, then pepper-sprayed her in her eyes. <o></o>
<P style="LINE-HEIGHT: 12pt">"While she's still on the ground, on her stomach, they tased her in the back and in the breast," her lawyer said. <o></o>
<P style="LINE-HEIGHT: 12pt">Police said they pepper-sprayed Crowder after she refused to stop kicking them. They admit that Crowder's prosthetic eye fell out at some point, and that Zajac stunned Crowder with a Taser, an electric stun gun, twice in the lower back and once in the upper back after ordering her to stop fighting and resisting. <o></o>

Those articles&just makes me sick.& And people still think that we have any kind of rights in this country?& I love my country, but I hate the b******s that "control" it.& I have not respect for and do not trust the government of this country or the judicial system of this country.& The things we hear now about cops and the things that happen in the courts are as shocking to us as the type of things that were happening in Nazi Germany, when Hitler first took over, were to the German people.


Now I'd better shut up.
