IMHO, those public employees should be allowed the protection of the Constitution when reporting situations that reflect badly upon the operation of government.
In the military Oath of Office, it is incumbent upon those taking the oath, to support and defend the Constitution and laws against enemies both foreign and domestic. The word domestic would fall clearly upon those public employees that would violate laws, and to deny another public employee the right of protection would be the same as denying that reporters obligation to defend the Constitution against enemies domestic.
