Happy ending

Here is an experience from some patriotic folks in northern Colorado.

Quote:
Thank you for the recognition & all that. Hell . . . it may have been just a fluke, who knows?

What happened is this: (Voirdire Process . . . maybe a good Forum to convey what needs to be conveyed)

I was told to keep my questioning to a limit of 5-minutes. The five of us (the result of a half-room-full of Prosecutor deal-takers) who stood our ground and wanted a Jury Trial were brought back into the Court Room to voirdire the Jury pool prospectives. The four people ahead of me 'passed' on the selection process, I did not.

Being my turn, I was told, by the Judge to go ahead and begin the process:

I began politely thanking, from the bottom of my heart, each and every one here in the pool this morning for taking the time to participate in this Justice system we do have here in The United States of America.

I then made a short statement: "I am in a dilemma . . . this morning before you with a 'Charge' of 'No Drivers License' against me". The problem I am faced with is somewhat like this: singling out a Women in the pool, in the second-row back, in front of me . . . pointing directly at her saying: does this group of people around you know that your Husband beats you? . . . pausing for a few moments further saying: "the answer of 'Yes' is an 'indictment' as well as a 'No' answer".

Addressing the pool further: 'Yes', I do not have a 'Drivers License'. 'No', I do not want one. Once the Jury is selected, I will demonstrate how 'lawfully' I am not required to have one. I will demonstrate further how the Municipality operates under 'color of law' and 'Private Process' while we have 'real law' to our availability . . . which is our real protection, under the state and federal constitutions.

I then asked the pool: "All of you who have a 'Drivers License', raise your hand . . . all raised their hand. I further asked is there any one who does not have a 'Drivers License', raise your hand . . . no one did. I then said: I now have a real-problem . . . you all are not my 'peers' . . . you are not my 'equals' (as defined in law dictionaries) . . . (to be dealt with later . . . maybe dismiss the whole Jury pool? . . . may be an option). "I will move, for now, move past that.

Asking a couple of questions more along with minor mumo-jumbo, I was interrupted by the Judge, asking me to stop and for me and the prostitutor to approach the bench, we complied. I do not remember the exact wording however, it went something like this: Mr. Prosecutor, the state is not pursuing this case any further, it is being 'dismissed'. However, the state reserves the right to re-file the case, against you, in the future. . . . . . . . . (Fine, fine, fine, to my self). The Judge then handed me a small manila-color rectangular-shape card and said: "Take this over the window and give it to the Clerk, I did. The Clerk asked me, handing me a sheet of pre-printed paper, asking me to just fill in my address of where was staying and my telephone number where I could be contacted . . . she further stated: your money (450.00USD . . . . part of my House-payment I had on me at the time of being picked up) would be shortly be mail back to you . . . (To myself: "yeah team" . . . my learnings from the law reform community).

A special 'Thank You' to those folks who attended the event, who supported me by being on-hand to 'witness' any shenanigans and/or misdeeds . . . Yesssssssss! . . to each and all!

I hope the foregoing may be of some help in the future for you 'Fighters' . . . alias, 'Court Room Crash dumbies', like me . . . , out.

Boys & Girls out there . . . be brave & knock'm down

My distrust of attorneys says that the strategy was simply to refile. Having her bonding by endorsement of the bond money, the judge, maybe even the same one could simply deny her that defense and push the trial forward without peers.

The moment she began to participate in the trial, she would have defeated her own argument.

At least the two attorneys (prosecutor and judge) left that opportunity open for the future.

Regards,

David Merrill.

I like happy endings. And additinaly the insight on how a sequal might not have a happy ending (like in the movie The Empire Strikes Back...), seems like some good forsight.

Thanks David!
