Re:land patent affidavit
Greetings all;
All I did to get the Patent is what everyone told me! First thing is a good abstract, you should have that instead of title insurance whenever you purchace land. Bring it up to date, find the original Patent, fee simple, grant, or what ever instrument passed the property from the U S government to the original owner. This info is available from the BLM website, just put in your range township section etc. and search the database. Assemble this with your decleration of land patent affadavit on top, and file it in your county courthouse [difficult but doable just be persistent, they have to take it]. Wait for them to record and number it, copy it, and give back your original packet. Then I filed the& recorded& Patent with the Secretatry of States office {by registered mail} and published& the affadavit in the local newspaper for a week.
The county doesn't like the city very well here, so they did not tell the city of the patent until it was done. the city got wind of the patent and does not want to get into a fight to the supreme court.
Its a pain in the rear to get together but well worth the security.
By the way, the county recorder asked if I intend to pay my taxes when I was recording the Patent! I told them I would pay my property taxes, as I don't want services to be withheld [fire, police,water, sewer etc.] but if this was where I could be self sufficient of these services they can't make you pay the taxes since your original patent supercedes state law.
Success is good!!!!!!!!!!!!
Give a man the knowledge and he will find his way.
Thanks, Don
