Contractor's licenses??

Some cities pass ordinances "requiring" a city contractor's license
to be able to do work in their city. Does anyone here have any
information on people who have fought this.

no, but what you could do is write a affidavit and send it certified mail to the city's attorney, council and mayor and tell them they have to rebut the affidavit in which you say that the supreme court and constitution prevent them from licensing a right, do a default and file it into the courthouse and go from there. thats the simpliest thing i know to do without arguing with them. make them show the law which gives them the power to overturn the law which is binding on them.

As you may well know ordinances are not Law. Also, a license is “the permission by competent authority to do an act which, without such permission, would be illegal, a trespass, or a tort. People v. Henderson, 391 Mich. 612, 218 N.W.2d 2, 4.” (“Black’s Law Dictionary Fifth Edition”)&
Think for a moment. Who is or would be a competent&authority?&
Is the act illegal?
Is the act a trespass?
Is the act a tort (violating a Right)?&
If your answers were no to all the above, then would you need permission (license)?&&<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o

In my house I would be a competent authority. In your house, you would be or could be a competent authority. In their city, who would be a competent authority? 
Do you have a specific issue in mind? 
With more specific information, I’m sure there are some on this site that could give you specific remedy or information.

Read the constitution. No one can impair your right to contract with whomever.

This may be a little off the subject, but in being sovereign how do you get around having to have a license to work?& I am an RN and there is nowhere in the country that a nurse can work w/o a license.& I'm too old to change careers now, and I do have to work.

There are some professions that you do have to have a license to work because noone will hire you.

You are hilarious with your answers.& I am going to call you King Jerseee.

However, I would like to ask you what consequenses that you think will happen in he "just goes to work"?

I am not saying that you are wrong, I just think that it is important to anticipate what the "authorities" might do in a situation like this.& Also, the person acting in accordance with the Constitution should be educated enough to defend their actions.& I say this in a general sense.& Rory, please do not take offense as I am not insinuating that you are not able to defend yourself.&

To answer your question, "What are the consequences that I think will happen if he "just goes to work"?

The answer is simple..........he will get paid for his labor.

If Rory reads the constituion, knows his rights under the law, studies, and he must believe in what he is doing (king). I believe he will be okay.

Besides there are hundreds if not millions of people that work everyday and do not need a license. And if he is a contractor, that is a more honorable trade than an esquire.

What could happen is that they will invite you to court.& You can beat anything they throw at you.& You can then claim that they are "maliciously prosecuting" you... and seek damages... punitive damages.& Of course, if it gets to a point where you file a claim against them, they will want to settle.

Don't "trip" about it.& If anyone wants to contract with you... then go for the gold.& But, get all your facts ready so that you can inform the "city" what they will&need to prove IS NOT THE LAW OF THE LAND.

Allow me to quote myself: "The big truth is this: YOU ARE KING.& They must come before your throne and lay the proof of a thing at your feet.& If they cannot, then your servant, the judge, will order them to begone from your royal presence."

And also: "The best advice anyone could give is: Know the Law, Know the Court.& Hold any accuser/asserter to his strictest proof of claim UNDER THE LAW."

I want to thank you all for your input. I will go into more detail in the next day or two. This forum looks like it's going to be fun....if your not having fun your not doing it right.

I got a call last night from another contractor and he was spitting nails about all the "new" edicts from the city. They went out and hired a hoodlum from out east to be the new building assessor/inspector.

Welcome Rory,

My brother works under a general contractor and we were ranting about licenses and building codes, and most of the issues that have been discussed here were covered.

I also mentioned that if I were a workman who had to have 3rd parties inspect/approve my labor I would be very insulted. But most look at the inspectors as an authority figure, deserving of respect. How backwards!

I like Jersee's anology of the King and the Servant. Does the King bow to the Servent when he enters the room, or ask the Servant for his approval on his descisions?

I think not!
