The continuing saga...
Today I called the JA for the case and asked her about the copy of the dismissal. She told me the plaintiff had not sent it to them as of yet, but that I should call them and tell them they need to send it. She also told me they should send me a copy of it but if they didn't I should call her in a couple of weeks and she would see that I get a copy. So, guess I'll call them tomorrow or Friday and see about getting my copy. :-)

Paperwork and more
The paperwork that I used was the VOD that Jersee used with some editing.
I also have to say today, 11/28/04, I received the dismissal. It states:
Comes Now, the Plaintiff, EXCALIBUR I, LLC, assignee of PROVIDIAN NATIONAL BANK, and files this (its) (his) (her) voluntary dismissal of the above captioned cause without prejudice pursuant to the Florida Rules of Prodedure, pursuant to the request of the Plaintiff.
Signed by the attorney on November 4, 2004.
So, now do I need to send them the second notice of their failure to send my VOD back and/or do I need to forward a copy to the CRA?

Keep in mind this is voluntary dismissal and it is WITHout prejudice, meaning they can reinstitute at any time. However, I would do some research and see if there is something in codes, etc that you can use to permanently slam this sucker shut!

All,
There is a case against Providian that is not in their favor. I cannot remember the case but I believe it is some ammo you can use.

Major CC Sucess
I'm excited to report that I just had success eliminating a Capital One charge card (total owed $32,000) using Jason Whitney's (Law Research Group) Unsecured Debt Resolution Package. I sent the Verified Actual and Constructive Notice of Final Payment with a check for $25 on 10/6/2004 and just received my Equifax Report and Capital One is reporting a zero balance. (It does have account closed by credit grantor status in the comments but the balance is gone.) The reason I'm so excited about this is because it was so quick (less than 2 months from start to finish) and easy. I didn't even have to contact the CRA's, Capital One apparently did this for me. I had been writing letters to the CRA's requesting VOD on 3 accounts (including this one) for over 8 months now with no success so this was very exciting.
