Hey There Everybody!!!
Great day today, just like Spring.
I went to court over my computer printout citation with a graphic of the officers signature and my signature missing.
When I got to court at 8am I waited for about 40 minutes before the City Attorney (CA) called me in to her office. When I got in and sat down she said she wanted to discuss the charges. I said well there are some administrative things that must be taken care of before we talk about anything. She said like what I said like I was not arraigned. She said that's a matter for the judge. I said and that the bailff entered a plea for me. She said that's a matter for the judge. Then I said we don't have anything to discuss yet. She Said well I need to ask you if you had insurance on the day of the citation. I looked her straight in the eye and said NOTHING!! Then she said ok did you have a valid driverlicense on that day. I repeated myself. I said there are motions and administrative things that must be taken care of first and I have nothing to say to you and I got up and walked out and she started dialing the phone.
So of course the judge said my motion was no good because it wasn't timely and I said neither was the City Attorney and he said denied.
Then I said your honor I have not bee arraigned and I have not entered a plea. So he looks through the and he says the court record shows you have been arraigned and you did enter a plea. I said then there is a fraud upon the court. And he flinched when I said that. VERY noticeably. ANd so of course they procedded with the trial.
So the officer is on the witness stand (in the box) and she asked him about his training and how long he had been a bpolice officer and all that crap. She asked him what drew his attention to "the defendent" and he said she tried to talk to me but I couldn't hear her because I had my helmet on and the radio runs thru that and I can hear. Add then he said he noticed I didn't have a seat belt on and that I didn't have license plates so he stopped me.
He said that I was cooperative but that I told him he would have a financial obligation if he used my name. He said that he issued me the citation for no ins, no DL and no seatbelt. They asked why he didn't issue citation for no plate and registration he said cuz you can only put three charges on one citation and he didn't want to be there any longer. Keep in mind when he called in my name he knew right away I had a DL.
And there was some other little detail stuff that went on and then it was my turn.
I asked the officer if it had been raining that day and he said no, that he would not have been on his motorbike if it had been. And the CA said objection irrelevant and I said the officer inticated that I was saying something to him and that he couldn't hear. He did hear me and responde to me and that's the relevance. The judge let me continue without interruption. I said do you remember me asking you "Don't they give you guys any rain gear?" And you said I don't need it I'm tuff. He said I may have said that.
Then I asked what his legal determination for stopping me was and he said no plate. I asked why I didn't signe the citation and he sid because we use the I packet. I said your honor I would like to say that I revoke my signature because I have never seen this document Obection objection Sustained. So I said nothing more and CA asked a couple of questions.
Then the CA rested. ( No mention of seatbelt) So I say your honor the first time I say this document entitled State of Nevada Reno Police Department was on December 8 and this signature is a forgery and is revoked. Judge says that's not your signature, I said NRS719.100 says that if you use an electronic device for a signature the person signing has reason it is going to be on the document it is intended for. I said the citation doesn't not have my signature and this document where my signature appears is a forgery.
Then we got back to the CA and she asked me if I had proof of a DL. So I went throught the discovery packet they game me pulled out my DMV record and I held it up and said here is proof right here! THat was soooooo much fun!!!! OOOOOUUU she didn't like that and said I mean the actual physical "copy" of you drivers license. I said I am not sure where my driver license is but this is proof. And the judge said ok. Then she asked me for proof of ins. so I handed her a bill. She says to the judge this is a bill your honor it is not proof. I said your honor all the information is there for your to call the company and see that I was insured on that day like you do with everyone else. So the judge says well Ms. Snedigar why don't you have a seat over here and I'll take care of the rest of the csses and you can wait until we can get to it and hands it to the bailff take it out to confirm. And the Bailff tells the judge this is the last case there are no more.
So the judge tells the bailiff to go check it. Well in their hurry they wouldn't realse any info to him with out more information so he had to come back into the court and get the file. Ha ha ha ha that was so funny I had them all twisted up. Then the bailiff comes back and says you had ins that day. The judge comes back into court and says ins and DL dismissed then asks the CA about the seatbelt. So she says the officer clearly stated she was not wearing a seatbelt. The judge asks me if I have anything to say and I say I opjecet to these proceeding for no due process I object that I never entered a plea and that I was never arraigned. So the judge says "There is reasonable doubt that defendent was wearing a seatbelt so I will dismiss that. Judge says or do you want to object to that? I sid no.
And that was that!!!!

I am missing something.
So you are saying that you did not have any plates on your car? or only 1 plate. You were pulled over. You refused to present DL and POI and you didn't have a seat belt on. So he gave you a ticket for not having a DL and POI?
Congrats on the win there. It is strange that they caved in though.

YUP that's what happened. He stopped me for no plate and cited me for no DL POI and seatbelt. Now he calimed he didn't want to use any more time to write a citation for no plates. Here is the deal, he knew I had a vaild DL at the scene. They did not bring up anything about UCC and they were hoping I wouldn't either. So I hooked him up in a lie on the record, and that he had testified on the record he was confused. If was actually funny some of the stuff that went on in there.
I would be more than happy to share my Notice and Demand for Discovery and the Affidavit along with my Motion for extention of time and the Affidavit for revoking my signature if you would like to use these things.
