Re:CC discharge SUCCESS

Aloha,

I feel like I'm in a 'dog and pony show'.&

I'm getting these ' . . . thank you for contacting us blah, blah, blah, regarding our Capital One account.& I am sorry for any misunderstanding surrounding this account.& C. One has a valid contract with you for the amounts you owe and reserves the right to take appropriate action in the event you fail to pay the full balance owed blah, blah, blah'.

Got 4 letters like these from Cap. One.& The largest discharge of $5400 says, blah, blah, blah . . . your account balance is $179+.& The statement I got says, 'payment received-thank you' and on the same day 'returned check'; balance due $5400.

I'm not complaining but it just goes to show how they try to get you back into the game.

I am preparing to follow up with more documents i.e. A4V with a bond.

Just sharing what's going on here.

Hula

Re:CC discharge SUCCESS

hula,

Have you asked the CRAs to verify the debt?

If not, you are only half done with the process.& Think about it....you have tendered payment but, they are reporting to the CRAs that you are late or some other negative remark.& Now you ask the CRAs to verify the validity of the debt (YOU ARE NOT DiSPUTING ANYTHING).

Hint: dispute means to disagree or better yet..."argue".

You only want the CRAs to verify the debt that is all.& If they ask you to fill out a dispute form....I personally would never do that because it is none of their business about the particulars of a contract.& they just need to verify that the debt is or is not valid.& take this stance on the issue and see what happens.

You need to have the CRAs involved if you don't already.& because if the CRAs can't verify the debt--then it does not exist.& And C. One can't comeback and say that the CRAs do not count and that you still owe them.& Well if the CRAs don't count, then why were they reporting negative information to a public agency?& they can't have it both ways.

I am planning to take care of CRA issue.& This week.& I'm enjoying myself so much, I've been wishing I didn't have a 40-hour work week outside of the house.

Re:CC discharge SUCCESS

Last June 2003 I got a strange letter from CAPITAL ONE also and I accepted it for value and returned it for discharge with all the fancy artwork on a copy of the bill.

They sent another bill the following month , no late fees and just added interest. So I accepted it for value too , on both I just wrote the ein numbers nothing else.

I got one more bill from them inAug. 2003 and this time I put all the numbers on it, ein, closed checking account , UCC filing number RR number from registered to John Snow then got really wordy on the diagonally written acceptance 4 value part signed by auth rep in red ink and a value of $1135.00 dated it and signed the back of it just like endorsing a check. The debt vanished and I havent heard from them since.

Re:CC discharge SUCCESS

Michael Olson,

Is it on your commercial person's credit report still?

This is how you know if it vanished or not.

Good to hear from you again.
