I have a success story to share with you all. I did this for my Dad who is being hounded by MBNA through the NAF. I used a slightly different approach than the NAF letter in the downloads section. I conditionally accepted arbitration pending VOD by the collection vultures, Wolpoff & Abramson, which of course they did not, could not do. So now I have "proof" from the NAF, which my Dad can use should this ever be litigated, that no VOD occurred resulting in the closing of the claim by the NAF.
I am trying to upload the 14 page file to the Example Forms & Letters - Laws & General section but keep getting an "Error" message. Please keep checking over the next few days to see if it uploads succesfully.
Please post any questions to the forums as private emails can take up a lot of time and also so that everyone can get benefit from them.

Looks like the file uploaded succesfully. Thanks SJ.
I also uploaded the NAF's CODE OF PROCEDURE with parts relevant to fighting the arbitration highlighted in blue. Makes it easier to refer to the important sections without having to go through the whole thing.
Both files were uploaded to the Example Forms & Letters - Laws & General section.
That having been said, I STRONGLY URGE EVERYONE WHO WILL USE THIS APPROACH TO NONETHELESS READ THE ENTIRE CODE OF PROCEDURE SO YOU UNDERSTAND WHAT YOU ARE DOING. DO NOT USE THE LETTERS AS MERE TEMPLATES. Thank you.

Did you get a letter back from NAF? What did it say? Mine said, "indefinitely suspended." But thanks for the reminder -- I told them that if I had not heard from them in 30 days, I would take their silence/lack of validation as agreement that they had no valid table upon which to proceed. I also used their Codoe of Procedure. I had requested validation four times from Moore and Ass. and each time was ignored. I finally did a private default on them.

A conditional acceptance I sent to the NAF lead to a success as well. The case was dismissed. I have thought about getting the order domesticated in court, but don't see a real need at this point...especially considering the shenanigans they often pull in court.

I would attempt to domesticate it. What better way to finish it off once and for all? You will likely prevail on summary judgment as I doubt they will respond. Plus, helps to remove it from your credit profile, if that is at issue.

My letter said the case was closed, without stating whether I had prevailed or not. Seems to me that's what they do rather than admit than a consumer might ever beat the CCC with whom they are in bed. That might be the best we might expect from the NAF
I am trying one more time to upload that file. I've made about 3 attmepts, I think, and the file will not upload correctly. I have asked Weis for his help in getting this done now that he his handling that part of the site.

Hi,Everyone
I just got a letter from debt atty. in Atlanta telling me I had an agreement in a CC contract with Chase Manhatten providing for resolution of claims or disputes by means of binding arbitration...then goes on to define it.
Then they tell me their client will honor this contract provision.They say this is where they will go if agreement can't be reached.They say they are not licensed in my jurisdiction so someone local would be retained if an arbitration award is obtained.I read the down loads from buscador's latest on NAF rules of procedure and was hoping to find the form of his letter.Is that available now and I'm just not finding it or is there still a problem with loading it?I'm still such a newbie to this, it's quite intense.Thanks for all thoughts and help. Also,this is their first communication with me other than calls I have not answered.
