Yes a business can be operated from a trust. We set them up as Unincorporated Business Organization's (U.B.O.) where the shares can be issued for capitalization similar to a "Massachusetts Trust."
Remember, anything you can do in an LLC, S-corp, C-corp, or 501c can be done privately in a trust. A trust is not subject to taxation even though the IRS sometimes has a different opinion.

&While doing a search for Bogerts on the web, I came across this- http://pw1.netcom.com/~rogermw/nts.html- While I am unfamiliar with Trusts and their operation, this article makes for interesting reading. I&believe that this gentleman is using various means of mis-representing the truths in what he proclaims, but I don't have enough knowledge of Trusts, to discern fact from fiction. Could you& enlighten us?

also, OT, does the bogert's book cover merely statutory trusts, or does it go over "contract" (PTO, whatever you wanna call it) trusts as well?

Bird... Yes that is the book I was refering to. Make sure you ask for the "Professor's" edition.
LT2DOGS... I took a cursory review of the site you provided and believe it or not I agree with some of that which I took the time to read. As with anything I'm sure there are points where our viewpoints would differ.
Jon... Bogert's covers the responsibilities of all parties in the trust relationship while providing substantive case law for its construct. We never get into the statutory arguements because we know how to defend them. The link that LT2DOGS provided has a good treatment on Pure Trusts. Basically they are targets for the IRS because of their construct and the over-zealous constitution speak...

that's interesting, the people over at SORCE190 ( http://www.sorce190.com) had a similar thing to say about MBTs - in fact stated that any MBTs that had assets listed were to be liened, siezed, and forced to "descend" (i'm sure that's what he said).
still waiting on a return call from K. so that i can get better informed...
