Some success with CRA



Yesterday&I got my first real response back from a CRA.& In another thread I had mentioned the problems that I had had with Experian..& Last night when I got home from work I picked up the mail and had& a response from Trans Union.& It was on my husbands CRA.& At the bottom of the first page it hadthe "Investigation" Results.


Item& Description& Results


Citibank UCS& #************** Deleted


Discover&Fin. Ser.& #************** Deleted


MBNA America #**************& Deleted


Household Finance #************* Deleted.


those were the ones I had listed in the letter.& They sent an updated report and there were some i didn't know about, and so I am going to write another letter listing those, and thank them for their prompt attention.& (It was about 2 weeks ago that they received the letters.)


I was thrilled when I saw that even though it wasn't that much, it felt like a victory to me.& Now I am anxious to get the rest and see what they say.&


One of the accounts that they deleted was an account that i may get taken to court over- the Household account.& Will this report stand as evidence that the account couldn't be verified?& Just wondering.

The answer to your last question is a big YES.& If the CRA couldn't verify the account then there is a question as to its validity.


What you are doing is building a trail of "evidence".


Can I ask what the Household account is?... is it Credit Cards or some other type of account?

One more victory for the forum.

Donna,

I want to let you know how big a piece of evidence this is. Not only can you stand up and support your claim in court in honor, against the fraudulent creditor that you speak of but, if the other CRAs are not deleting the items that you needed verification of, then you have a valid claim there as well! If you ever decide to file a claim against Experian for damaging you--you can prove that you gave all 3 CRAs notice at the same time to ensure accuracy and a timely response.

So let Experian keep playing games, Ice and I know exactly what you have....UNDISPUTABLE EVIDENCE FROM A PUBLIC INVESTIGATIVE AGENCY.

Way to stay the course and have fun.

HEY DONNA....


WAY TO GO!& YOU ARE A COUPLE WEEKS AHEAD OF ME IN THE PROCESS IT SEEMS.& THIS IS ENCOURAGING TO ME.&


I HAVE JUST STARTED LUCY'S PROCESS TODAY.& THE "FORTUNATE" THING IS THAT, SO FAR, SHE'S NOT BEHIND ON ANY PAYMENTS.&


WE'RE TEMPTED TO SEND TO SEND REQUESTS FOR VERIFICATION TO THE CCC'S AT THIS TIME AN FIGHT THE BATTLE FROM TWO FRONTS.


I GUESS I COULD START WITH THE CCC'S&WHERE I AM BEHIND IN PAYMENTS.& CAN'T LOSE ANYTHING THERE, EXCEPT WHY BOTHER WHEN THE CRA'S CAN DO IT FOR ME?& I'LL JUST WAIT UNTIL THEY ARE FINISHED.

In answer to your question- the Household account is a revolving signature loan.& We had a line of credit, and could write checks on it.& However, at the same time we took that out we took out a 2nd mortgage.& That particular loan wasn't tied to a mortgage or anything.& I am wondering if that would help us in terminating that second mortgage?& Since they were both taken out the same day?& Any ideas.& Again,& thank you for your help, and Jerseee- thank you for stomping the way for us with these CRA's.& this is really getting exciting.& It's so encouraging to see all these things happening with members of Sui Juris.& And thanks again to Sui Juris for making this website possible.& It has been and is being such a blessing to so many people.

I haven't tried terminating any debts that way, but I don't see why it couldn't work.& It's like Jerseee said- they area public&investigative agency.& I think you could definitely put the cart before the horse in this case. It can't hurt, and you will be building your paper trail.....& Good luck.& Let us know how it works.

Here's an idea for you... study the Cornforth info... it will help you when it comes time for court.& I think you'll probably start with a motion to dismiss due to the fact that there will be no evidence on the record... as well as a few other issues (such as jurisdiction, standing, etc.).

Ricky,

From your post it sounds like "Lucy" is still making payments. If this is the case, "lucy" may not get the results desired. Because the debt is validated by her monthly payments.

Donna,
If you think you might go to court you need to get&a "certified" credit report. There should be a phone number on you updates report to call with questions and such. Start early!
