I won a case.
I can't believe that I actually won.& Jerseee said in a post a while back that it wouldn't be long before my sucesses started stacking up and it turns out he was right.
A while back I answered a summons and complaint for some medical debt.& I also counterclaimed with everything that I could find in the FDCPA, that related to my particular case.& Some great points that I stated were that they were collecting in somebody elses name as they were putting the original creditor on the documents with the totals owed, even though they stated in the same documents that they were the owners of the debt.& Another was the fact that they purchased the evidence by purchasing the debt, and that if they did not purchase the debt but were just collecting the amounts in question for a fee,&and if they&were doing that, it's called debt adjusting, which is clearly stated in Montana code that it is illegal and punishable.& Then of course, I mentioned that due to all of the above, the plaintiffs were bringing fraudulent claims before the court.
Anyway, one of the points in their answer to my counterclaim said that my only purpose in saying such things was, "for the purpose of harassment."& That statement makes me want to laugh and be angry at the same time.& How dare they call me harssing just for standing up for my rights.
Anyway, that all happened about a month ago.& There was a pre-trial hearing set for today and as I was getting ready to go I realized that I hadn't listened to my voice messages from yesterday.& I listened to them and the first one was from the Justice Court and it said,"there is no need for you to attend your pre-trial hearing scheduled for today because the case in question has been vacated."& I literally had to sit and think about it for a minute before I actually realized what had happened.& What a fabulous victory, not only for myself, but for all of us.& It is cases such as his that verify we are right.& We are all capable of doing these things.
I spent a good portion of my day composing this post in my head and I started to think about all of the people to thank.& Then I began to feel like I was composing an acceptance speech for the oscars or something.& I felt silly for a minute and then I thought, so what, I feel like I've just won an oscar, I can act like it too.& So here goes, Jim has been so generous with his time in helping me to get my documents right.& He is a wonderful individual, and even though a bit ornery (and old) (<FONT size=1>wink</FONT>), I am thankful to count him as a friend.& RICKY who is a personal friend of mine has made a wonderful study partner as it seems when we talk on the phone, we often find ourselves listening to each other mummbling as we are each reading at the same time, and Jerseee, who like I mentioned above, told me that I could be successful and gives so generously of his time to us all.& Thanks to ICE for leading me to this sight and to Sui Juris for providing this medium.& (I told you it sounded like an oscar speach, all I would have to do to top it off would be to thank God and my fans.)& To all others who have shared their knowledge and studies, we are winning and we can't give up out of frustration.& We have to stick together and beat the system.
I haven't seen the papers yet about how exactly the case was vacated, but when I do I'll tell you what they say.

I forgot to mention Big Sky in my above post.& She is my older sister&and she is amazing at finding great code and making sure that I get the stuff that pertains to my particular case.& As I am a full time student she is a great help due to my lack of time.& Also, she watches my kids whenever I need her to so that I can do things like spend time at the law library and go to court.
Thank you Verina (Big Sky)for all that you do to help me and others.
