Re:Newbie Day in Court

Yes your driving liscense name is in Capital letters making you a fictious person, enity or what ever you call it,

My name is Derek Latimer Sitton or Derek Sitton, Latimer choose one and always sign that way I use the second but on my liscense it states SITTON,DEREK LATIMER which is and error and i gave the liscense back and said you mispell my name thats not me. DMV replies this is how the system does it. I say sorry but it is in all Capital letters making me a fictiuos person and&if I am going to place my name and be bound by this agrrement than you need my correct spelling of my&name. DMV says Im sorry we cant change it& this is the system so I say sure and sign Derek Sitton, Latimer right under neath(without prejudice)&UCC-1-207

She says what do this mean. I say well you are forcing me to except the spelling of my name incorrect, and lie on a state application&which I think is a major crime(just said it that way).&so inorder to protect my-self and&rights this is how I will sign. She&says so what as long as your name is sign. So I got in on with out a long dispute.

&

Just sum it up it was longer than that but I got it on so If I am stop for something not implying to break the law but hopefully the cop will notice it and if not see him in court

hAKEEM

I was under the impression that a person could simply write "Without Prejudice" (leaving UCC etc. off) and that would be sufficient to secure your common law rights.

Does the UCC 1-207 give it any additional power?

Re:Newbie Day in Court

From my understanding, it would give it "additional power" being that it sites commercial/contract code by adding ucc 1-207.

Re:Newbie Day in Court

Won't let you sign that way in NY.

Tried it last time I was up for renewal and they kicked it right back at me and said that the only way I could sign is 'just' my name.

So, I said 'okay' and then added it to the license after I received it from the DMV.

Don't know if it would hold up as the 'official' digital signature on file at the DMV does not have the UCC 1-207, without prejudice notation.

Just as a thought for anyone out there - Is there any precedent that anyone knows that could be cited to force them to accept the notation along with the signature?

As always, thanx for the research info!

Re:Newbie Day in Court

couldn't you just assert "that is my signature."

the burden of proof would be upon them to say it is not.

Re:Newbie Day in Court

I got mine sign that way, I guess the clerk was tired and diddnt care but im sure. Next time it will be harder. Ok update.& Dont know if it is true but was told if you dont drive a bus or truck (car pool) you dont need a liscense but once you transport passengers(bus, truck) car pool or transport someone who has a DRIVER liscense than you are required to have one. Lawyer told me I won b/c I had no passengers with liscense or job that requires a liscense at the time I was stop by the Police but he also stated just reclaim your right& meaning UCC-1-207 you must if not you are under the law. Now business are stating you need a driver liscense to work for them just another scheme. Once you are redeem I was told you could not do business with a fiction something like that you can but once you do you contract your rights away thats the only way we loose our rights is by CONTRACT.

&

Recently I did a test. Register.com has a program i sign my name two ways. Without prejudice ucc 1-207 with my name and my name with out it.& They deny my application with ucc 1-207 but excepted the other.& Same thing happen with other sources. They understand Contracts and ucc. We just have to be wise as a serpant. my next step is to resign my bank cards

Re:Newbie Day in Court

Has anyone had any recent experience with signatures and the Department of Motor Vehicles (DMV) in California?

Re:Newbie Day in Court

It's funny how they always want your signature... but then they want to tell you HOW to sign your signature.& I guess "this is my signature and it wouldn't be my signature if I did it any other way" doesn't work?

Kind of insane... isn't it?& If you have other cards or do***ents in your possession that contain your signature... wouldn't that be proof that it IS your signature?
