I thought it looked like it got removed out of state court and into the feds. ??? What did you read in it?

It came with commentary that it was a rare instance of the state court judge refusing to have it removed... the motion for removal was denied. The most recent action is release of the lien. But I did not look close before posting it.

Good find David. Five years it took, I would like to see some damages awarded so the attorney's can start cannibalizing themselves.

Unfortunately it seems up to the state court's discretion whether or not to honor the Treasury (USA) motion to remove to US district court. This actor/judge likely terminated his or her career by keeping the matter in state court.
So agreed. I hope we can get the best milage out of this matter. I hope that any example made by punishing this modern Martin Mahoney (Credit River) will develop into a heroic martyrdom.

Yes, I believe you are correct. The states have concurrent jurisdiction, however, they cannot be compelled to hear issues involving federal matters.

A couple details worth sharing:
1) this was emailed to me yesterday by a suitor who earns his living in the securities industry.
2) the emails (now deleted) were between Richard James McDONALD and some of his associates. Richard was edifying his (state Citizen) folks about the case.

The lien has been reinstated by the feds and this is no win at all unfortunately. I have it on good authority the feds removed to federal court anyway. If I can find the info on it I will post.
