Hello,
I am uploading an appointment of Fiduciary that should be used if tender of BoE has been rejected by the IRS. This has a Letter Rogatory incorporated and is effective in dealing with the IRS.
It has been uploaded.

Rejected? What happened? I thought the government was the party that took the use of the exemption with no resistance?
What can you share?

[color=black][b]The other side of the coin is to also draft the Snowman himself to see whether or not the debttorneys or mortgage folk even went to the Federal Window to have the BoE tendered in the first place. Even though the Snow can't disclose private info to whoever the DIB head is, he should be duty bound to tell us if we ask whether or not the opposition even attempted to tender the BoE. If you get the letter back from the Snowman saying they never tried to collect, they will look like they weren't very duly diligent. I have a draft of such a letter. E-mail me & i'll fax it.

Weis,
The Snowman will not even respond to that line of questioning. The Letter Rogatory, if put together properly, will do what it needs to. You can also setup a miscellaneous file with the federal court to compel the IRS to show cause why the records should not be changed. From what I hear so far there is no need. The IRS does not want to go before the Data Integrity Board for a hearing.

Weis,
I am preparing another Affidavit for the Fiduciary and copying the court regarding the Fiduciary's due diligence in his investigation of the nature of the BoE, and whether he went to Snow or not.

Need to make a correction. The miscellaneous file is setup with the frderal court so that if you need to go into the court you have the evidence needed to compel the IRS to show cause. You would go in under adversity of citenzenship.

RPT,
The reason that the IRS rejects BoEs is for the same reason the banks do. They do not go to Snow and in fact when one files their original paperwork with Snow the IRS agents will intentionally misdirect the paperwork. Nothing is made easy and you didn't expect any different did you?
