JUSTICE DEPARTMENT SUES TO HALT ALLEGED INTERNET TAX SCAM
Georgia Man Allegedly Sold Fraudulent Tax Schemes to Customers in 41 States
WASHINGTON, D.C. - The Justice Department today asked a federal court in Atlanta to bar Jonathan D. Luman, of Lovejoy, Georgia, from selling an alleged tax scam via the Internet. According to the civil injunction complaint, Luman operates websites that sell bogus documents, including a manual known as the "Tax Buster Guide," containing forms which customers are told to submit to the IRS in lieu of tax returns. Luman allegedly told customers that the documents would allow them to reclaim their "sovereign citizen" status and eliminate liability for federal income taxes. The complaint contends that the manual, which is sold for $49.95 with blank forms and for $299.00 with completed forms, has been sold to customers in 41 states.
The Justice Department’s complaint also seeks an order directing Luman to give the Department of Justice any records that identify his customers, including their names, street and e-mail addresses, and Social Security numbers. In addition, the complaint seeks an order to require Luman to post the court order on his websites.

I wonder what they are alleging is wrong with the forms? Isn't it the problem of the person buying them if they actually use them incorrectly?
The real reason is apparent in the body of the story: the identities of those who bought them, not really the seller. Just like when the IRS/DOJ went after Larken Rose to find the names/addresses of those who had purchased his 861 video (both the taped version and the minicd version).
It's desperation to attack them before they can continue to spread the word. They are doomed. The genie is out of the bottle. Too late. Only a matter of time.
In other news (old now). Sherry Peale Jackson, former IRS agent, and currently labelled a 'tax protestor', got her house raided in a very staged, public way.

Look at the court documents. Funny how they confer upon themselves the jurisdiction.
I wonder if we could use this as an exercise of the Cornforth material. Anyone want to try?

<font color=darkblue face=tahoma>Does the Assistant United States Attorney have the authority to prosecute an American Man for a Crime? I think not.
I would venture to conjecture that the US Attorney's job is to keep corporations in-line with the Code and there would need to be a specific delagation of authority to act against a sovereign.
but then again. ..i'm just thinking out loud.

<fonr color=black>[b]If I understand this properly, The U.S is claiming to be damaged. If there is no witness claiming an injury , then no JD(Jurisdiction), right?
Which leg is that?
If the U.S. Atty starts runnin' his mouth, then we can object till Kingdom Come, right? Is this a good place to start-A motion to dismiss for lack of Jurisdiction. Motion to Vacate? I was thinking also to Motion For a more definite statement because the complaint doesn't specify Subtitle A tax because throughout the complaint they use the word "taxes" without specifying. It seems like they are offering him a contract. What sayeth Sui Juris?

Seems to me the DOJ wants the defendant to argue like they did with Eddie Kahn and ARL. There are mistatements in the complaint designed to get the defendant to argue the issues, which will create a dishonor and give them jurisdiction in the matter. There are no charges and they are hoping the defendant will do the same thing Eddie Kahn did and that is to hand jurisdiction to them. Just my take on things.
