Company Medical Plan - Pre-Tax Rip Off

Anyone know the legality of pre-tax medical credits?

In short, my company allows us to have a portion of our paycheck set aside each month in a "flex credit" account. All medical supplies on "the list" (i.e., Tylenol, Ibuprofen, cough suppresants, co-pays, etc.), are reimbursed from this account once receipts are submitted.

Here's the rip off - if you don't use the money, the outside company that handles the accounts confiscates it. Of course, this wasn't really disclosed on the company intranet when you are signing up.

So, all I did was print out a form and confirm my benefits. Interestingly enough, the flex credit doesn't show up on the page I signed.

Anyone got an idea of the legality of this or how to get my unspent money back.

I've attached a copy of the confirmation statement I signed.

Yes I know of these.

You may set aside a certain amount of money each year for medical expenses. This money comes out BEFORE taxes AND is not counted toward your gross annual income.

Check with represetative first because I am sure for me that is how it is but it may be different for you.

Also any money not spent will be forfeited.

As far as I know one can spend the money on asprin, ace bandages, doctor visits, cough supresent...

Mine is all voluntary and you have to sign up for it.

Right, mine is the same too - its all pre tax and its all voluntary. However, since there was truly no contract signed other than what I previously attached, I'm questioning the legality of the system.

If anyone has any ideas on how to approach this and how to obtain my unused money at the end of the year, please let me know.

Otherwise, I'll keep you posted on how it works out.
