Just got a 10 day seizure letter from the IRS

What to do what to do?



I just read Weis's post about who you are and who you arent, and I understand that.



I sent a CPN for a $500 Civil Penalty a couple months back.



The letter that I just received shows it has not been applied to that penalty.



Can I get a copy of Law Work's first letter Weis?

Just got a 10 day seizure letter from the IRS

Hey HB, why not ask them to produce the Liability Statute for Subtitle A "Income" Taxes (signed under penalties of perjury), that gives them the authority to produce such seizure letter? Just a thought..

What exactly is a 10 day seizure letter? Are they planning to seize your bank account or something?

Hmm... ever wonder why a length of time of 10 days shows up in these situations? I hear that the California FTB puts a 10 day wait on seized bank accounts before the money is to be sent to them.



I recall someone finding a section of UCC that says that a 10 day grace will be given when receiving a letter in which it can be returned refused without dishonor.



Rice McLeod breaks it down like this (not sure if it is right):



3 days - contract

7 days - default

10 days - summary judgment

A 10 day (Urgent! We Intend to Levy) notice is not the last notice you get before the levy. The 30 day notice of Intent to Levy comes after the 10 day notice. So you still have approx. 45 to 60 days before they actually levy. But you can be sure that they have a lien already- they just haven't sent it to you yet.



You'll get an opportunity for a COLLECTIONS due process hearing before they levy, but sometimes not, if you have an employer they can grab the money from.

HB, You probably already know that silence creates Estoppel, when a legal or moral duty is required to reply to your requests. Perhaps as Tora has indicated, you should demand the Collections due process hearing, then hold their feet to the fire, and require them to produce the Liability Statute. (Assuming they have "proof" that you are a "tax payer" and thusly required to pay taxes for a Statute (LAW), that does not exist.) And as rushpat has indicated, return the offer within 3 days. If you haven't searched yet, look for "mail strategies" in these forums. Just yet another thought....
