Notice of Non-consent to IRS Chief Counsel

Perhaps some may have seen this, some may have not. Submitted to the downloads section under "Taxation" in .doc format, pending the usual approval.



**NOTE** Any sub-humans seculating and diseminating information on this site, should be willing, ready and able to answer to, and be held personally and "professionally" accountable for failure to address every point in affidavit format. Ignorance of law is no excuse!!**END NOTE**

This message applies only to those men and women who have made their own determination they are nonfilers.



One of the first items of interest is the IRS Form 4506-T which can be downloaded from http://www.irs.ustreas.gov/pub/irs-pdf/f4506t.pdf .

Item #6d states you can obtain verification of your nonfiling by

completing the form and mailing it to the appropriate address listed on the back of the form. Within approximately 6 to 8 weeks, the IRS should respond with their Letter 1275SC "Verification of Nonfiling."



The second item of interest is the fact that in a free society, the government cannot lawfully act against a non-consenting party, without an order of a competent judicial court that has acquired jurisdiction.

NOTE: USDC's are administrative in nature, they are not judicial

courts.

The letter is to be used each time you receive correspondence from IRS. The instructions are simple:



1. Copy and paste the letter to your word processing program (Word,WordPerfect, etc.).



2. Insert your name & domicile info at the top of the page.



3. Change the date of the letter.



4. SSN - Optional(for those of you wanting to clarify the identifier number in the system of records they maintain on you).



5. Do not change any of the mail recipient names/addresses.



6. At the end of the letter, insert your name.



7. Be sure to include the (2) enclosures.



8. Change the first copy recipient below your name to that of the federal employee who sent you the correspondence, and their address.



8. You can save the expensive cost of sending certified return receipt mail by sending the correspondence to each recipient using first class postage and a Proof of Service by Mail (check your county courthouse or Website for the form & instructions).

The format may be more effective if constructed in "Negative Averment" format, affidavit enforced. Slime maggots and scum beware!!

I am not a federal judge, nor a member of congress, nor a federal

employee. I am not a resident of, nor employed on, federal territory,

or federally owned property, enclaves, or buildings. I have reviewed

the Restructuring and Reform Act of 1998. I object to being addressed

as a taxpayer and I object to being contacted by one of the

Secretary's employees.



I have not freely and knowingly consented in writing or otherwise, to

be federally governed nor federally taxed. I've performed my due

diligence research to learn about your employer's authority and

jurisdiction. I act on the basis of the facts stated below. When you

think the facts are incorrect, please notify me in writing of your

corrections within fifteen (15) days from the date of this

correspondence. Otherwise, your acquiescence will indicate the facts

are true and correct.



I'd like to know more about you: your duties and powers. Whenever a

person claiming to represent the government contacts me I must make a

general inquiry of that person's authority and capacity. Please

furnish copies of all laws or regulations pertaining to your contact

with me, one who is outside the venue and jurisdiction of your

employer.



I expect your specific, detailed answers to the below questions:



1. What branch of government is your employer: Legislative?

Judicial? Executive?



2. Are you an elected or appointed official of that branch of

government?



3. Are you aware that the creation by the Constitution of a

government of three branches makes it impossible for the People to be

part of the legislative and executive branches unless they become

elected or appointed officers or employees?



4. Are you aware that the separation of powers prevents members of

one branch from performing the functions of the other two?



5. Are you aware a person is prevented from being forced to act by

the legislative and executive branches acting alone or together?



6. Are you aware that free American governments were divided into

three branches for the purpose of protecting the People from

governmental abuse?



7. Are you aware that the doctrine of separation of powers is a

executive branch of government, are contacting me in an attempt to

obtain financial support, called a tax?

its determination and collection is not a matter that can be left to

11. Do you have power or authority to discharge the duties of any

branch of government?

citizen to comply with any rule or regulation?

15. Do you have the authority to create or serve legal notices and

16. Are you aware that the only branch of state or federal government

that may have direct communication with a state or United States

citizen is the judicial branch?



17. Are you aware there are no justice courts in the federal

judiciary within the several states?



18. Are you aware there should be no occasion for me to be contacted

by federal employees for the federal legislative and executive

branches?



19. Are you aware that I have an unalienable right not to be part of

federal government?



20. Are you aware that I refuse to consent to be involved in federal

government?



21. Are you aware that I have no written legal obligations with

respect to any branch of federal government?



22. Are you aware that I owe allegiance to the People of the state of

my domicile, but the only specific duty owed by both men and women is

the duty not to engage in treason or traitorous acts?



23. Are you aware that the Declaration of Independence established my

right not to be governed by government or other men?



24. Are you aware the People are limited to and cannot be burdened

beyond the legal duties we had on July 4, 1776, under the common law?



25. Are you aware that the Declaration of Independence accepts the

Creator as the only power over the People and acknowledges that

governments exist to secure the Rights endowed by the Creator?



26. Are you aware when government that "becomes destructive of these

Ends" endows the People with the Right and Duty "to alter or abolish

it"?



27. Are you aware the People's Right and Duty to alter government

makes certain the concept that written laws have exclusive application

to government and not the People?



28. Are you aware that while the abolition or alteration of

government requires enough People, one person is sufficient to refuse

consent to be governed.



29. Are you aware that as a member of the People, I am protected by

my freedoms?



30. Are you aware that because of those freedoms, I am free of any

obligation to ally myself with the federal government?



31. Are you aware only courts with judicial power have authority to

provide justice?



32. Are you aware administrative courts are incapable of dispensing

justice because they are not established as judicial courts with

judicial power?



33. Are you aware that government cannot act against a non-consenting

party without an order of a judicial court that has acquired

jurisdiction over that party?



34. Are you aware that in order to have a judicial proceeding at the

federal level, a case or controversy must arise with the executive

department?



35. Are you aware that to create a case of controversy, the executive

department must put a person on notice and make a demand for

performance; otherwise no obligation is recognized or has arisen?



36. Are you aware an order resembling a judicial ruling may be made

by a federal judge resembling a judicial officer, but that order can

only be issued in accordance with the power of the legislative or

executive branch?



37. Are you aware that documents having the appearance of judicial

process are administrative and not judicial; issued pursuant to the

authority provided to Congress in Article IV of the Constitution?



38.Are you aware the executive branch still must obtain an indictment

before a criminal case can be adjudicated in the federal courts?



What is the name and address of the Ethical Grievance Committee or

Board to which I might report any

misconduct on your part? How long have you been employed with your

agency; how long in this position?

What was your previous employment? What are the name, job title and

authority of the person that instructed

your agency to contact me?



If I give you information, records, or statements, what

will they be used for? Who will see them? What other agencies,

whether Federal, State, or Foreign can and may receive copies of any

documents or materials furnished by me?



What is the specific nature of your duties, your job

title, your job description, areas of responsibilities,

powers, obligations and duties? What is your education: formal or

on-the-job? What is the name of your

immediate supervisor?



The Privacy Act of 1974, 5 USC 552a(e)(3), your agency

regulations and IRS Publication 876 mandate

certain procedures on your part, such as:



(3) Inform each individual whom it asks to supply information, on the

form which it uses to collect the information or on a separate form

that can be retained by the individual- (A) The authority (whether

granted by statute, or by executive order of the President) which

authorizes the solicitation of the information and whether disclosure

of such information is mandatory or voluntary:



( The principal purpose or purposes for which the information is

intended to be used:



(C) The routine uses which may be made of the information, as

published pursuant to paragraph (4)(D) of this subsection; and



(D) The efforts on him, if any, of not providing all or any part of

the requested information:



I want your personalized, detailed explanation to the above, not just

another copy of your employer's publication. Regardless of the reason

your employer contacted me, I expect your complete answers to the

above questions.



The Federal Court of Appeals has ruled that you must furnish me with

this information. Your agency

regulations require that you answer these questions. Do not contact

me by telephone; always correspond with me by writing.
