Angry Taxation - State and Local (Wisconsin) question

In the state of wisconsin all lands are allodial.

On the other hand it appears that we and many other states have still on the books ties to the english system of land ownership:

From the State Constitution:
Feudal tenures; leases; alienation. SECTION 14.

All lands within the state are declared to be allodial, and feudal tenures are prohibited. Leases and grants of agricultural land for a longer term than fifteen years in which rent or service of any kind shall be reserved, and all fines and like restraints upon alienation reserved in any grant of land, hereafter made, are declared to be void.

Not much hope remains in ever having allodial rights recognized. Despite many state constitutions using the term allodial, most states are completely feudal. Only two states stand out, Nevada and Texas, Nevada having recently instated a new higher form of land title and property rights. Although these titles are far superior to commonly held titles in other states, they fall short of making the grade.

Dr. John Cobin, professor of Economics, graduate of George Mason University, and one of the foremost analysts of allodialism in America commented that, “ante-belleum America's system was quasi-allodial and was quite possibly very close to true at points.” When asked about the Nevada and Texas titles available, he added, “Real allodial titles are never "granted", they are recognized. If granted by the state, you have nothing more than a higher form of feudal tenure perhaps sans taxes. So whatever is granted in Nevada or Texas is obviously not allodial. Like a land patent, it is just a higher form of feudal ownership.”


Ok so I have no problems with paying fair taxes. Meaning that we do have to build roads and provide public meeting places and salaries for our "servant" government.

Not only am I being charged a land and building tax but also school tax and I have no kids. That would seem to me as if it were not apportioned, putting me in a situation where by I am being taxed without representation.

So that is issue number 1.


Secondly I have the city coming on to my property with the claim it is within their charter to insure I am in compliance with all city ordinances and codes. They actually "police" neighborhoods and then on the cities website "brag" about how many orders they issue every year.

They came on my property earlier this year and noticed that I had my boat trailer with one tire off the cement and wrote out an order for me to remove the "vehicles" from the unauthorized parking area. No further explanation was given even when talking to the head of the get this: "nusiance" department. They later sent a man out who misquoted the ordinances such that would have required me to make an "improvement", instead of simply telling me one tire was off the edge of the pavement by 3 inches.

As our fight continued they levied a lien, (fine), against the property during the course of my attempted negotiations with the man in charge of the nusiance department.

It seems that I am getting more regular visits from them and their visits are getting more petty and now add misrepresenting the code to the mix. I had to go to the city legislative department just to get the correct definitions and understanding of the code.

So I am unhappy about the taxation issue and I am unhappy about what appears to be "treading on me".

Does anyone here know what course of actions I can take or am i doomed to what appears to be a violation of my rights.

There is nothing inconsistent with what your state is doing. Your land is allodial if those rights were conveyed properly in the transaction, which I doubt.

In all real estate transactions the land is granted, given away freely and is considered a gift. If the gift, however, is not accepted who does the land belong to? The giver, so the allodial rights to the land still belong to him and if that person were still alive today he would be within his rights to charge you land rent.

Your problems exist because of contracts related to the real estate not the land.

Thanks gldskr.

It sounds like the wisconsin const is not making a declaration then but an acknowledgement that lands previously considered allodial will remain so? i will have to look further thanks.
