Ever think about challenging the IRS's "jurisdiction" ?



Since Alaska became a state and they removed it from the list of "territories and possessions" of the U.S. I would think that any IRS agents would need to produce a "delegation of authority" in order to operate within said union State and upon that union State Citizen.

I would demand that they prove you are a "taxpayer" and that you are liable for the so called "income tax". Just because a woman has all the equipment to be a whore, doesn't mean you have the right to call her one until you can prove she is through facts. In Botta v. Scanlon 288 F.2d 504 (1961) the court said: "However, a reasonable construction of the taxing statutes does not include vesting any tax official with absolute power of assessment against individuals not specified in the statutes as persons liable for the tax without an opportunity for judicial review of this status before the appellation of "taxpayer" is bestowed upon them and their property is seized and sold."

Make them prove their claims.

The more I post on this forum, the more I realize that I am answering my own questions! Thank you GOD!!

Here is another approach. File a la Pete Hendrickson and then ask the Taxpayer Advocate for assistance. Don't get hungup on the "Taxpayer" part after all it is only a game right? Nothing "legal" about it (their game, that is).
We, however, are trying to follow the law. Check out Pete's take on it!!

Maria, have you done the method successfully? Can you show us the certified mail documents you sent them, w/ the postmark on the green card, etc . . with a letter from them to you or a refund check xeroxed w/ your name on it which would prove that you used this method & it worked?

The IRS is not using "legal" methods, nor does it ever claim to. It's power is purely "adminstrative" and goes unquestioned by the courts. To get it to court, and thus make it a "legal" battle, you are going to have to take on the role of plaintiff, including all that nasty "burden of proof" stuff. Why do you think the IRS avoids court?
