Fired Today

I was A new hire at a co. in fl. I submited in writing the codes of W-4's being voluntary and i did not give permission to take taxes or give info to the IRS and I was told today that i had to sign the W-4 W/SSN or go home, never did they address the validity of my arguement the just sent me packing. What kind of recourse do I have if any?

Thanks Tom

Since I don't have a SSN and haven't been an employee for many many moons, I could be all wet on this, but...

My guess would be, the only way you would have a chance of recourse, is if you could prove that it is against your religion (your Law) to accept a SSN (mark of the beast).
Employment Discrimination Based on Religion, Ethnicity, or Country of Origin

Then again, based on that same Law (religion) you wouldn't sue. A catch-22.
Just a thought.

Peace

Some useful documents

Now that you have free time... you can go Pro Se and come up with a nice lawsuit to get your job back. Or possibly you can negotiate with the HR department at the company on the matter. If you can construct a compelling arguement and show them that they are not at risk for not having that form and number.. then it may be an alternative.

Most sheeple HR directors have never been sued on this.. but it is a cut and dry win. If it were me I would sue for actual damages and punitive damages .. hit 'em where it hurts.. the wallet.

I personally know someone who sued Erie County, New York for being fired over a similar issue a few years before his pension and retirement. His lawsuit took almost a year, but he got over 100K and his job back. It was kind of cool because he was a "in your face" kind of guy and he really wanted the county job back just so he could say he did it... he was literally untouchable at the county because they would have needed an order from the surpeme court to fire him again.

You weren't fired. You simply weren't hired.
If you want to work you'll have to allow the theft, or starve, so get used to it- you don't have any other choice. It's tough to watch a thief steal from you right before your eyes, but... as I said, if you want to eat...

I wouldn't use any codes because there's nothing legal about what they are doing- The employer has no authority to collect taxes, and he collects taxes as a condition of employment; both functions are illegal.

Since you are forced to submit a W-4 you'll have to write something on the form to that effect ("under duress") and plan a strategy for IRS issues. Good luck.
