Didn't read any other responses 'cause I'm not really gonna give any advice.& But...
Been going through the same stuff with the good tax-people here in VA (4 years now).
Finally got their attention real good a few weeks ago.& Since the VA Code lays all the responsiblity and authority on the "commissioner of the revenue" to do the assessments, I fixed up a nice 25 pg letter, holding HER accountable for this mess (referring to our local commissioner).
She called and asked me to come see her. Didn't take her two minutes to tell me she had NOTHING to do assessing alleged "income taxes." (Well, duh.)& So, she was in no position to verify the alleged debt AND had no authority to attempt to collect.
She is supposed to have contacted somebody in the VA Dept of Tax who, according to her, is really fair and helpful, blah blah.
Anyway, if you haven't, you might wanna try the same thing. Check the state laws. All I've ever looked at seem to be written by the same bunch of people. If so, make your little locally-elected commissioner take the heat for it all.
Remember, you're not battling "the" taxman, just "one" person at a time. And whether&they like it or not, they're still just trying to collect an unproven,&unverified debt.&
Stick to THREE things:
1) Unproven authority to collect.
2) Unproven debt.
3)&Un-verified debt.
Everything&else is, well, irrelevant.
Oh, yeah. She (commissioner) asked me I had filed a return. I told her that whether or not I had& was now a moot&point since an alleged assessment had been&made resulting in attempts at collecting an alleged debt. She agreed, but wasn't really happy about it.&
Be happy to email you a copy of what I sent. Might give you some ideas.
