Unhappy Real Estate taxes/personal property Taxes

I need help to help a friend, she is behind on her personal property taxes on her home, is there a bond or BoE to pay her taxes, she is afraid they might try to take home, I am learning these processes and I am not sure how to help her.Any suggestions?

Greetings,

First off, is there a mortgage on the property? If so, it is more likely that the bank will foreclose using breach of contract. The towns don't like to be the bad guys if they can pass the "ficticious" buck to the banks.

Thanks for replying, yes she do have a mortgage, isn't there a bond or CPN that can be used to help her? Isn't there a way to discharge this debt?

My county assessor will pay for your property tax if you cannot afford it until you sell your property before they get their cut back of taxes pay on your property. Check with your county if they have sort of package for helping the home owner.

I would suggest you use a foreign BoE, but unfortunately there is no case law that I know of backing the BoE instate, as that is considered an inland BoE. Here in Florida I have a Florida Supreme Court decision regarding foreign BoEs and states that foreign BoEs must be protested as a requisite step before there can be prosecution. No Notice of Dishonor, no prosecution. They define a foreign BoE as one that crosses state lines. In this case it would be difficult to prove the BoE is not inland even though it is foreign. Going from a flesh and blood to a fiction makes it foreign also, but no case law on it.

I have used a foreign BoE successfully against Discover Card and now have one issued to Bank of America, out of state of course. As soon as I supplied the case law and the statutes here to Discover's attorney they went away.

As far as property taxes are concerned; this is a tough one. We are working on it, but have no solution yet. I know it does not help your friend, but will let you know if anything pops.
