Tax Trouble and Credit Reports
Hey all. I just received a warrant from the NY State Dept. of Taxation for a tax bill in 2004. It says the warrant is equivalent to a money judgment and it is filed with the County Clerk's Office. It says that, if the bill is not paid, the judgment will remain in effect for 20 years (10 years against real property) and may adversely effect my credit report.
My question is, once I pay this tax bill this week, will this judgment get removed/deleted from my credit report (if it is actually reported to the CRAs)? If not, how can I get this deleted from my reports?
I also have another tax question regarding W-4s and state/federal tax exemptions. My boyfriend's accountant says that a person can claim up to 4 exemptions and not have a tax liability at the end of the year? Is this true?

Hopefully you pay it before it shows up on your credit records. If not then you write and ask the credit reporting companies to validate and verify from the person whom put it on your account and they will have 30 days to get rid of it and if not you have a legal case against them. It is the law Not that, that makes a difference  Good Luck Bobbie

Your boyfriend does not have a magic number exemption. If one is going to fill out a W4, the IRS is going to assume you made money that they want a cut of it, period. The more exemptions you file for, the more money you get in your paycheck...and possibly the more you mail to the IRS on your Form 1040. My wife, who cannot stand questioning authority, and cannot convince her school district employer of the optional nature of a W4, agreed to claim 7 so that we keep most of our money.
No, I do not fill out the confession form in violation of my 5th amendment right granted by God(1040), so the IRS sends me periodic letters asking me to pay for this year and that year and that year. Why? Because some stupid W4 form filled out once.
I would not recommend claiming exempt and submitting the W4. That not only is a red flag, but the employer will be advised often to withhold as if you claimed zero. Not legal, but that doesn't stop the common person from trembling to do ANYthing the IRS tells them.
Sure, enter four! But it is your choice if you pay and how much you pay. Understand, though, once you sign your 1040, you are no longer "secure in your papers." You waived that right. "Doouh" as Homer says.

Ask for proof that a bill = a court judgment. Don't ever assume that they are telling the truth. These are licensed thieves, remember?
Give them some time to responsd, follow up, etc. Ask the county recorder to provide a copy of the notice. They may be lying about the county recorder having it. Ask if it is filed with liens, then follow the lien removal procedure written about in other parts of this forum (and the web... ucc-11 search, ucc-3 removal). If you can get the county recorder to remove it, because it was bogus due to no real court judgement, then it shouldn't be too hard to get the CRAs to remove after you demand verification, as they are supposed to check with the county recorders where supposed liens are concerned.

KT, I was wondering who would catch that! I don't know, i wanted to claim 20, so I guess it was a compromise since I knew we had 7 sled dogs.

I took another look at this "warrant" today and it is unsigned . . . . If this same warrant was filed with the County Clerk, how in the hell did it get filed without a signature of an authorized officer?????

The N.Y, didn't know you were there. I lived in 5 different places there in my first 2 years of college. Just about everywhere but the park bench!

You don't want to set up an in-your-face meeting to determine the facts in which their opinion is based?
No negative avertment with a default clause/notice of default/final default filed with the county recorder?

It sounds to me like they are offering you a way out in an implied sense.

[b]If you do decide to pay, you are going to have to go INFACE NY STYLE, BABY and demand they put it in writing that they won't tarnish your NAME. State in writing that you will be irreparably injured if they do that to you. Request the meeting in writing stating the latter as well. attach an affidavit in support for however you plan to do it - Affiant denies you have authority to tarnish affiant's credit . . .

Never heard that, can you please get the statutes/bylaws in which he bases that?
Have you looked at our Keep Your Wages Thread in taxation, some of it works, some of it doesn't. depends on your vibe, or whether or not the employers has any guts or some semblance of intestinal fortitude
