FOIA Request to get your IMF

Just want to let all know that the IRS is now stating they do not want FOIA requests sent in for IMFs any longer. What they want is for you to fill out a form 4506-T to get your IMF. There is a nifty little area where you sign that you are the taxpayer requesting the IMF. Of course I will continue to submit a FOIA and if they do not send the form I will file a complaint with the Court of Claims and collect on it. Looks like the alphabet agency is trying to contract with us so that we admit to being a taxpayer.

Thanks Weis,

I did not mean that it is about me and you are correct that it is not my IMF. It is in regards to the strawman. Thanks for the correction and keeping me in line. That whip really hurts too. lol

I'd been reading rumors that they were resisting IMF requests for almost 3 years now.

I thought they wanted everyone to know the truth. Gee, I wonder what the problem is.

iamfree2, did IRS notify you by letter or other means that it wanted 4506-T?
I am working on cleaning up an IMF. I did receive a response in December for an earlier request but have not yet received response from 2 in March.

A letter came with the IMF stating: "Requests for documents which can be processed routinely in accordance with established procedures will not be diverted to Privacy Act or Freedom of Information Act procedures simply because the requester may cite such Acts.

Please consider this our final response to your request"

Yep!

It's been around three years, then silence (no response what-so-ever).

Around the Michigan area, anyways.

Q?

Dear Mr. Paul Mitchell:
I have but one request at this time.
What address do I send a FOIA request to
regarding Title 26 Sec. A, substitute return
type requests? To get my IMF. in FULL..

Answer:

For purposes of the Freedom of Information Act,
IRS is NOT an "agency" as that term is defined
at 5 U.S.C. 551(1)(C):

http://www4.law.cornell.edu/uscode/5/551.html

because they are domiciled in San Juan, Puerto Rico.

Therefore, FOIA requests should not be addressed
directly to them.

Submit your FOIA request(s) to the Disclosure Officer
listed at the website of the U.S. Department of the
Treasury in Washington, D.C. They have a full-time
FOIA staff there. If they must refer your FOIA
request elsewhere for the answer, then do request
that they do so.

Use Google:

http://www.google.com

to search for:
"U.S. Department of the Treasury"
and Google should find their homepage for you.

Sincerely yours,
/s/ Paul Andrew Mitchell

Inquiry:

I have just found your website and I want to thank you for all the hard work you have done and for making it available to all of us. I will make a donation next month as the irs has caused the bank to freeze all my money in the world that I have this month. I am a 59 year old professional that has been forced to retire medically because of acute coronary vascular disease and I live on disability retirement, which as you are probably aware, amounts to less than 50% of pre retirement income. I can hardly pay my monthly bills, much less pay federal income taxes. Now comes the irs and takes my money and leaves me with exactly 3 one dollar bills and pocket change. When I called them to protest and inform them that I was unable to buy my life sustain medicine for the month, their response was "if you would pay your taxes you wouldn't have this problem!" Needless to say they would not remove the notice of levy from the bank. Now I want to fight!!! I now what your policy is for pro bono
advice, but I need to know how to decipher my IMF files that I requested under FOIA. I have the code book but can't seem to decode my IMF MCC Transcript-Specific.Any direction that you can point me would be appreciated. Since I have no money at present I will need to manually decode. Again thank You for your efforts to throttle that lawless group in Washington DC

Answer:

The IRS can ONLY levy a bank account by first serving a
court-ordered WARRANT OF DISTRAINT on the bank:

http://www.supremelaw.org/decs/odell/

.gif = Graphics Interchange Format (scanner output)

You should serve copies of this decision on the IRS
and on the bank(s) in question.

If you don't already own a graphics viewer,
we recommend ACDSee software for viewing
all types of graphics files.

God bless you, kind sir!

Sincerely yours,
/s/ Paul Andrew Mitchell

iamfree,

What did you end up doing with regards to requesting the IMF? Today I sent a FOIA request, but it appears the IRS will not respond to them.
