"Unsigned" Letters from the IRS

WITHOUT PREJUDICE
"Sign, vb. 1. To identify (a record) by means of a signature, mark, or other SYMBOL with the intend to authenticate it as an act or agreement of the PERSON identifying it. 2. To agree with or join." Blacks Law Dictionary, 7th Ed.

"Signature. 1. A PERSON'S name or mark written by the person or at the person's direction. Commercial law - 2. Any name, mark, or writing used with the intention of of authenticating a document."

Consider the following:

DEAR STRAWMAN:

SEND ME MONEY NOW, PUNK!

AGENT STRAW <--that is a symbol

My there be some hmmm deliberate reason for this kind of 'signature'?

UCC 3-402(b) might clear a few things up or cause more questions:

Point of the post was that "AGENT SMITH" is a signature in and of itself and could also be either a seal or stamp.

Huh?

What, exactly, did you expect at the end of the letter--a thumbprint, or perhaps the IRS agent attaching himself to it, bodily? Of course he's going to sign with his name.

Are you complaining that the signature is not the actual person? Gee, that's amazing!

Under IRS RESTRUCTURING ACT 1998 (RA1998) the IRS employees must give their full name, employee ID number, direct telephone number, under Act section 3503 (a). Of course their correspondence must be signed under penalty of perjury to have the force of law behind it.

The point was that a signature can be just typed/stamped text that is not handwritten. Perhaps you read a bit too much into it?
