I didn't see your postings above until today.
No, they do not send a copy to the victim. Your employer will send you a copy when they get it. You will then have ten days before they actually take anything out.
I received a letter from FTB Disclosure office three days ago regarding the Privacy Act and their authority to solict a tax return. I don't have any idea how my letter got to the Disclosure office, but... this is what they said:
"Please accept our apology for the delay in responding to your request. To the extent you are requesting information regarding the FTB's authority to solict and gather information, please review the Information Practices Act, Civil Code section 1798, et seq for a summary of your individual rights and the requirements of State agencies. For an understanding of your rights to any public information maintained by this agency, refer to the California Public Records Act with respect to any public information maintained by this agency."
They never responded the 18 disclosure requests I sent for back in July. I followed up with a Demand for the records but they ignored that too. I have prepared my complaint. All I have to do now is file and serve it.
FOIA lawsuits are supposed to be the easiest to win, but IMO, any lawsuit is still a pain in a**
One guy was awarded $350,000 in his lawsuit with the FTB. He said he obtained all the information he needed to do it through FOIA (or IPA for state of CA)
Anyway, I hope you will overcome their Withholding Order when it arrives....

I was watching a DVD from the Law Research Group about a guy that uses the Public Records Act against them. Apparently, if they don't answer within a specified amount of time, it is an automatic $1,000 fine.
You might want to go to their site and do a search on "how to cook a government crook".

I heard about it on the LRG's DVD called The Occult World of Commerce. It was good. It seems Marvin Bryer's info was more for judicial thugs, but it can also be used to a degree with the taxman.
Apparently, even one penny of money that is misappropriated would send a gov't official to jail. Also, not responding to the PRA requests is a $1,000 per incident fine against them (according to California rules). I think most other states have something like this. I'm checking into my own state's info on this.

$1,000 per incident? Does that mean "per" PRA request? I had 18 PRA requests in my first letter-- that would be $18,000!!  Probably not...
Thanks, Rushpat... I'm going to order that seminar because I will need help with motions just in case an EDD or FTB attorney twists my words around.. I will need to motion the court to stop it -
I hope it has a little motion info in it.

Okay, Rushpat... I will give a review after I get it. I should have it by next week.. Friday at the latest.
The Canadian I bought it from sounds like he has a much better service than LRG.

I have finished viewing the DVD. I don't know what to make of it. Although Mr. Bryer does mention in the DVD everything that is mentioned in the advertisment, this video is FAR from being a "how-to" video on "How to Cook a Government Crook". It's entertainment at the least. I did pick up a few tips here and there from it, but nothing significant was learned. The third video was dedicated to child support issues, but I don't see how that helped anyone with those issues, because he doesn't even give an address where you write for a copy of the documents that he used to help other people win their case.
Also, you can hardly hear the questions that are being asked in the audience, so it's kind of hard to follow.
The title of video is misleading. WARNING... How to Cook a Government Crook is not a how to video... my opinion, of course.
