Actually, I made a modified version of the initial letter, but the same attachments which I will also send to the general address. So, one to Goldberg, and one to the trained monkeys, so that maybe someone will bother to look into it.

Either way, I'm in honor and have responded within 72 hours of their offer of proposed contract. It goes out in about 2 hours.

I would think they won't bother to respond, as they can't. In a few weeks, I'll be on step 2 of the 1-2-3 default procedure and this time, they'll get an affidavit of non-response and default, and they'll also get one for last time. What does it take?

My family and&I escaped communist held Kalifornia in 1999, first moving to&one state&and later to Nevada. The FTB has placed a lien on myself and one on my wife. We knew nothing of this until we ran our credit to buy a car in Nevada. The only thing they seem to be able to effect in this state is our credit rating, and don't worry it has taken several years for this to happen. We had received "Notice of Liens" awhile back and because of my ignorance at that time I ignored them, hoping they'd go away. I felt secure in the fact that I was out of "their" jurisdiction. I still feel comfortable that I am. My question is this, how did the "county clerk" convert the "Notice of Liens" into factual "liens" and place them on my credit history? I suspect that this is illegal. These are non-adjudicated liens, where is my due process? My plan is to write the "county clerk" a letter informing them that I have discovered this fraud that they may have been a willing participate. They lack the "authority" to create debt out of thin air. They have created a commerical instrument&and I wonder if I should put in my letter that the SEC needs to be notified that fraud and a&felony may have been commited. I would at that point suggest that if these "liens" were to be promptly removed I would cease any further legal action.Otherwise I will be forced to file suit against the "county clerk" personally because I have experienced damages and hardships. Now if anyone on this list has any ideas I'm very open to suggestions. In fact someone may already know of a letter that I can use. Thank-you</FONT>

I work for a big company. They are based in Atlanta, so I don't think that the demands of a tax agency from another state would have much effect. They also don't withhold and don't even question an exempt w-4 (yes, I know it's not the best way, but it hasn't caused me any trouble in the 16 years that I've used it).

I would like to go contract eventually, and maybe even self employed or silent partner in a business. The farther from the tax collectors, the better.

Why do you ask?

So, the liens they put up only got onto your credit report? No debt collector calls or attempt to garnish wages or seize accounts?

If that's all, then perhaps you should look into the Success Stories and CRA sections and use Jersee's method of demanding the CRA's verify a debt or else remove it from your credit report.

I'm actually thinking that, unless they drop this entirely, that they may only try to use a 3rd party collector or a lien on the credit report, then Jersee's CRA method my remove it from my life forever.

How many years are they bugging you for? Mine is only 1 year.

If you want to get a Notice of Lien removed from county records, you might want to go to taxtruthnews.com (Eddie Kahn's secondary site) and read the story about how a guy used the UCC-11 form to do a search for the real lien (UCC-1) and couldn't find it and forced them to remove it from their records.

For the record here, I'm not ever planning to return to the left coast again, maybe never even to visit. The over-oppressive gov't out there is a real annoyance. But hey, they still have good weather...

But a levy must be accompanied by a "court order"... which means you would have your day in court... otherwise, any of your earnings turned over to the FTB by your employer WITHOUT a court order leaves the employer "liable" for suit.

Hmm... I wonder why they didn't do that with ironhorseman then?

I'm wondering if putting a copy of UCC on file with the employer will help. If it is a levy, I wonder what the options are for getting it removed, like you can a lien?

Ice, I think we then get back to the point that many are facing when their employer gets the dreaded letter from the IRS to start taking wages at single-0. It depends on the company and their willingness to protect against a taxing agency. In this case, I'm thinking that my company would be more willing to question a state taxing group, not of their own state, than they would, say the IRS.

I guess we'll only find out.
