Property Tax Dispute

I sent the following letter to the City of Philadelphia regarding my dad's property tax:

Dear [PHILADELPHIA DEPARTMENT OF REVENUE],

It is not now, nor has it ever been my intention to avoid paying any obligation that I lawfully owe. In order that I can make arrangements to pay an obligation which I may owe, please verify the five (5) following questions under penalty of perjury:

1. Can you reference and furnish which law requires Americans to pay property tax?
2. Can you verify your regulatory authority and delegated authority to address me?
3. Can you reference and furnish the law which makes your organization part of the constitution?
4. Can you provide your agent’s oath of office?
5. Can you furnish a copy of a valid bilateral agreement in which the four requirements of a lawful, binding contract are met?

a. Full disclosure
b. Equal Consideration
c. Lawful Terms and Agreements
d. Signature of the Parties




Thank you very much for your time and consideration and I do look forward to your prompt response.


This letter was sent on 4/15/05 and he just received a response this week. The only problem is that he agreed to a payment plan, so he contracted with them. I believe that was the only grounds they had to demand payment and that's why it took them so long to respond. I'm wondering what I can do know to continue my fight? Any thoughts?

Can you tell us more about the response?

I have been looking for a way to challenge property taxes. Misclassification is one -- classified as residential when in fact, it is private property. And some of the questions you asked as well.

Well my father didn't tell me that that he agreed to a payment plan because they demanded he pay a lump sum all at once. That was the only grounds they had to mandate he pay, contract is law so he's is stuck unless he is willing to continue fighting constitutional law in my opinion. I have used that letter with the IRS before and they left a friend of mine alone, just changed the wording from property tax to income tax.
