Sen. Boxer probably "fell totally silent" because she never had a chance to respond to any of the "pleadings."
According to the on-line dockets of the California Supreme Court and First Appellate District, Modeleski's petition in No. S030016 was filed in the Supreme Court on 12/1/1992, and the Supreme Court transferred it to the First Appellate District three days later, on 12/4/1992.
The docket in the First Appellate District, No. A059854, show that the petition was received on 12/7/1992 and DENIED on 12/15/1992, which pretty much was the end of the case.
So, from start to finish, it was only 16 days.
And some of the notes in the docket are amusing. Two days before the petition was dismissed: "Petitioner's Exhibits Are in C.J.'s Office if Pet. Wants to Reclaim Them."
And about a month after the petition was dismissed: "Called Modeleski and Left Message Re Exhibits Are Available For Pickup Til 2-5-93."
Eventually, the box of exhibits were shipped to the "state retention center" where they will eventually be recycled as compost.
What a hoot.
