It takes years. And even so, when somebody checks out your past they may acquire "your" SSN from when you used it there just by asking for it during a reference check.

So what I meant is when you approach a new company for an employer, they may treat you like a liar; "Your SSN is XXX-XX-XXXX. We had to get it off a former employer on your resume." And with a nation full of evacuated refugees hungry for work, well...

For instance in "real life" Panicpass probably uses his legal name routinely like it is his true name.

Note that "name" in a legal law dictionary is for all intents and purposes the same as legal name in common law. So it is easy without understanding the consent to a social compact, to perceive that there is a big corrupt conspiracy afoot. Maybe my words are falling on deaf ears but one must know these distinctions in order to gain control over contracts - to defeat presumptions. Even to be able to explain why your name has changed and you are allowed to extinguish your SSN just by ceasing to use it - at least in a three-sentence delivery to the personnel clerk at a corporation that has just hired you contractor or employee. And not sound like a complete kook so they just show you the door and blackball you to the next potential jobs.

In the 1828 Webster's Encyclopedic Dictionary this is called pseudonomania - false name craziness.

Your husband is interviewing in a very connected and information-sharing marketplace; regardless of what he does technically. * If you have paid into SS bennies for 40+ quarters, you are entitled to the bennies. Or so I hear. Check into it. If true and you have paid your "fair share" tell your new employer that you choose not to keep paying into the insurance premiums being that you have already met the minimum requirements. This may help you make sense about not wanting to use your SSN for employment purposes [the SSN as you know is required for a Taxpayer ID Number too.]

In real life nobody but God cares about my true name. I haven't been able to feed or clothe myself using my true name. If I figure out how to do that, I'll let you know.

It was not said to offend. I was just offering the fact to edify.

Thank you for amplifying the point. The legal name stands as evidence of a social compact; a constructive trust formed between you and society. Sometimes "True Name dba First Middle Last", suffices to ward off assumpsit.

Well... it happened today. They made my husband the offer. So now the pressure is on to find the real solution to our quest. He has gotten this far in the door without giving the mark (ssn). We will be researching passionately and will surely share our results.

So if ANYBODY has some secret, high-tech method of keeping a job without giving a ssn, PLEASE let me know! :-)

That is the best guidance I've come across so far!!! I have a few questions about that method:

- Is that how one would use the W8BEN?
- Is the ficticious business name a foreign entity?
- How does a company hire this entity as a salaried employee?
- How does this ficticious business prove that it is "eligible for work in the United States"? Would the DL with all caps name be sufficient?
- Would this ficitcious business be subject to witholding?
- How would this TIN keep the company from witholding the maximum amount from each paycheck?

You could have the company withhold the taxes until the outcome of this letter provided below.

Some questions have arisen at our firm regarding withholding of Social Security Tax and income taxes. This letter is an attemt at engaging your assistance in determining what law actually allows or does not allow. Because some questions have arisen about the true meaning of several pivitol terms used within the Internal Revenue Code, I am phrasing my questions in plain English and respectfully request you respond with a simple "yes" or "no" answer to each of my questions. As I know that you are busy, I have designed this letter that it also acts as your response. Simply mark the correct space provided after each question, sign your name in the space provided at the bottom of the page, and return the letter.



Question #1: Our firm is located in Minnesota. If a Citizen of one of the 50 union sates, who is working for me/us, does not posses a Social Security number, and will not sign a Form W4, do I/we have the legal authority for withholding any tax described within the Internal Revenue Code ? ___ yes ____ no

Question #2: If you have answered "yes" to Question #1, and I/we withhold funds out of this Citizen's compensation without possesing a signed Form W4, will the IRS guarantee my/our firm immunity from the consequences of criminal and/or civil prosecution?" _____ yes _____ no

If there is no response by the IRS within 30 days, the presumtion prevails that no authority exists for withholding any tax described in the Internal Revenue Code without a signed Form W4 and our firm will cease withholding funds out of the pay of the Citizen's that have refused to sign the Forms W4.

It is important to remember that this case never made it to court.

I have read it. An original transcript. I should have copied it but I returned it to the owner before I realized how many people have quarrelled about this incident.

Point being that the Taco Bell case is only some letters written between the 17 year-old's father and Taco Bell attorneys. That is encouraging but for the fact that if an IRS agent receiving letters like this responds he will lose his job. A pal of mine who frequented Taco Bell asked about the SSN and found that if the manager (friend) ever got an application without a SSN it would have gone straight into the trash!

So do not go down that dead-end alley. I am not trying to discourage people from following the truth. Just that there may be variations just as valid.

The birth certificate; treat that as a Tontine. And I am just blurting one solution. You and your husband seem bound to what is right.
