Thumbs down Public Defender

An idea:

Assume a public defender is ordered to represent you in a tax issue situation, ask the PUBLIC defender to show the law under which you is being charged. If he cannot produce the law.....?

Lightbulb Good Stuff, Stu

That's a foundational concept very much tied into the Vth & VIth Amdmts

Regarding the Vth, you want COMPETENT & CONFLICT FREE counsel, right?

Regarding the VIth, you need to be informed of the nature and cause of the charges, correct?

That is EXACTLY my point!

If your PD (the system) cannot tell you the nature of the charges being filed, what happens?

They side track you and confuse you by bringing up other matters or do what they did to I, " it's statuatory jurisdiction " and proceed to roll right over ya.

Well if he can't explain the N&C, THEN HE SHOULD BE FIRED FOR BEING INCOMPETENT(caps slip again)

If he is a member of the American BAR, then there is a conflict of interest
"His first duty is to the courts and the public, NOT to the client. And where ever the duties of his client conflict with those, he owes as an officer of the court in the administration of Justice, the former must yield to the latter." Corpus Juris Secundum Vol. 7, Section 4.
Is it administration of Just-US?

I want Cornforth to represent me as my competent and conflict free counsel

They? Who are they?

Your PD? Doesn't s/he have to inform you of the nature of the charges?

on a similar note

go to www.neopa.net/jacksmith and the 2005 directory -- open and listen to the 10/3 audio -- addresses the issue of IRS and the 5th.

Think you'll find it interesting to listen in on an "interview" --

Issue a subpoena against the PD, and question him/her as a hostile witness because they cannot inform you of the nature and cause of the charges against you.
